  3. New Law Reforms & Actions on Gun Control • The gun is considered an assault rifle if: President Obama urged Congress to reinstate the Assault Rifle ban passed in 1994 that expired in 2004. 🔫 • It is semiautomatic • Has detachable magazines 🔫 • Two of the following six characteristics: 🔫 or

  4. Crime Rates • Less than 2% of inmates reported carrying a fully automatic or military-style semiautomatic firearm So why would you try to restrict guns when the crime rate involving guns is falling?

  6. Taking away guns: Has it Worked in the Past? Failure: In the instance in Washington D.C. where the city police tried to remove the weapons from the public. There were thousands of people living in the city and in 1 year the police only confiscated a total of 283 guns.

  7. Has it Worked in the Past? Success: In Harrisburg the city officials, with the help of donations, started a gun reclamation program. In the program they offered rewards to any person that would give tips about illegal weapons. The program turned out to get many illegal guns off the streets.

  8. Has it Worked in the Past? Failure In the instance of World War II, Hitler applied laws to take guns away from the Jewish population. The Jewish people in turn could not defend themselves. The rest is history… That’s why we need our guns. What if politicians start to take a bit too much control? We need our guns if that ever happens!

  9. Mandatory Background Checks for All Gun Sales. Who stops criminals from getting guns? How can you be sure they’re not a criminal when not all the data bases are checked?

Background Checks In 1993 the Brady handgun Violence prevention act was passed which instituted FBI run background check, looking for a number of different conditions. • Has been adjudicated as a mental defective or committed to a mental institution; • Having been a citizen of the United States, has renounced U.S. citizenship According to the FBI.gov “More than 100 million such checks have been made in the last decade, leading to more than 700,000 denials” • Is an unlawful user of or addicted to any controlled substance; • Is subject to a court order that restrains the person from harassing, stalking, or threatening an intimate partner or child of such intimate partner • Is a fugitive from justice; But remember this only applies to 60% of gun sales. Anyone that is denied there could easily go to a private sale. • Is an alien illegally or unlawfully in the United States; • Has been discharged from the Armed Forces under dishonorable conditions; • Has been convicted in any court of a crime punishable by imprisonment for a term exceeding one year; • Has been convicted in any court of a misdemeanor crime of domestic violence

  11. Background checks are very important to keep the public safe. They seem to be effective but… Even though 700,000 people were denied guns , there are loopholes that compromise the public’s safety. So how can the government take away our guns when they have hardly tried to check everyone that is dangerous? Some of those reasons are… • Maine only keeps paper records, Maine has yet to add their mentally ill and violent offenders to the Federal Background Check. States are required to submit the names of those who have been convicted, but most are not added to the data base. • Others only add the recent convictions, but convictions past 30-40 years are still on paper records. • Many states still have paper systems just like Maine

  12. The System of Background Checks is Flawed. • Private sales account for 40% of all guns sold. We don’t need to increase our regulations on guns, but more efficiently enforce the safeguards already in place. Not to mention anyone that was denied by a federal certified seller, can always buy from the private sellers. • A private seller is anyone who is not a federally licensed seller. As I mentioned before there is no background check for gun sales from the private sector.

Gun Possession Will Stop/Lower Crime Rates If law abiding citizens could have guns it would reduce crime, because criminals would not know if the people they were attacking could defend themselves or not . This proves that an armed citizen is a good constant police-like force that can keep peace, and keep everyone else safer. In 2011 a shooter in Tucson opened fire in a supermarket and proceeded to kill 6 and injure 14 people. • Joseph Zamudio ran from a nearby Walgreen’s, he had a 9mm, thankfully he did not have to use it but helped restrain the suspect, Jared lee Loughner.

Suzanna Hupp’s Story In a Texas cafeteria on October 16, 1991 • Suzanna Hupp and her parents were causally dinning. • A man ran his pick-up into the cafeteria and began to open fire on the patrons dinning. Her parents were both murdered in the chaos. • Suzanna regularly carried a gun in her purse for self defense, but had stopped months before due to legislation limiting the carry of guns. • She felt that if she had her gun she could have stopped the gunman and saved her parents. • The gunman shot 50 people and killed 23.

Protection by the Constitution: Supreme Court Cases • The Supreme Court found that the handgun ban was unconstituonal and also having to be dismantled even when need for self defense was in violation of the second amendment. Heller vs. District of Columbia. • Background: District of Columbia made handguns illegal if not registered • Guns would have to be safely kept in the home and either be dismantled or with a trigger lock on. • Heller was a police officer that wanted to keep a hand gun in his home, • After being denied registration he filed a lawsuit.

  17. Protection by the Constitution: Supreme Court Cases The Supreme Court found that the handgun ban was unconstitutional. Ruling on Heller vs. District of Columbia: Having a dismantled handgun would serve no use to the owner and for that reason was in violation of the Second Amendment.

  18. McDonald Vs. Chicago Background: • McDonald is a retired maintenance engineer who lived in Morgan Park since 1971, when he bought his home. • McDonald wanted to keep the handgun in his house for self defense, which was in violation of the ban instituted in 1982. • After his property was broken into the 5th time he wanted to buy a handgun. • The neighborhood declined and was overrun with crime.   19. Where the 2nd Amendment Ends A topic that has arisen from the 2nd amendment is the line that you can’t cross with owning guns. Some people would surely try to own jets, helicopters, and other things that could technically be classified as a weapon. That is when the government should step in to control the sale of those things. Having those types of weapons in the hands in the public could lead to a disaster if they were used wrong.

  20. Unenforceable Gun Laws People that are against the possession of guns would claim that regulating illegal guns is impossible. There is the black market and all the private sales that an illegal candidate could obtain weapons. In turn the government or the state would have to watch over both of those sales. -Which would be an impossibility.

  21. However… The black market is practically impossible to stop, but responsible citizens can turn in anyone who have illegal guns. The police can then simply follow the illegal line of sales to shut down small black market. The police force will also need to be ready to deal with those kinds of situations.

  22. Enforcing the gun control would reduce suicides/homicides • "Nearly 20,000 of the 30,000 deaths from guns in the United States in 2010 were suicides" • "To Reduce Suicide Rates, New Focus Turns to Guns" New York Times • Suicide attempts made with guns are ussually more successful • Many families mourn and suffer because of a loved one acting under stress or depression or just irrationally.

  23. Disarm population As I mentioned before the fear that I personally have is that the Government would disarm us. You can think I’m crazy but if you look into the past you’ll see that disarming the population usually is the start of a dictatorship. My example before was Hitler in Germany. Joseph Stalin also created a dictatorship shortly after disarming people. The purpose to have guns was to keep our freedom and to keep the government working for us, not us enslaved by the government.
