Operational Challenges and Implementation bottlenecks • Inadequate awareness and support for making the claim- Lack of facilitation • Determination of Rights of few PTGs (Particularly vulnerable Tribal Groups), shifting cultivators, and seasonal migrants • The vast majority of OTFD applications have been rejected on the grounds that they are not 75 years of resident in the village

  5. Contd • Gram Sabha meeting at village level not at Tola level • Issue of Joint Forest Management and Community Forest Rights • Capacity lacking at different level • Low turnout of members especially women in FRC meeting and at Gram Sabha level

  6. Innovation & Best Practices • Convergence of Individual benefit scheme, specifically for land based development & production to land title awardees'. • Community Forest Right Campaigning • Facilitating Gram Sabhas in claim filing

  7. Focusing on PTGs, shifting cultivators, and women • Reasons for rejections of claims and its review and redressal at every level • Convergence and consistence in policies of different departments • FRA and rules translated into five tribal languages

State Specific issues for Clarification • As per the protection under Chotanagpur Tenancy Act & Santhal Pargana Tenancy Act in Jharkhand, tribal are having non alienable land • Under SPT Act absolute ban on alienation of private land • 81.27% of forest in Jharkhand is protected forest, where adjacent villages have been given many rights like rights of firewood, grazing, timber for their need, collection of MFPs etc. since long. • The conversion of Forest Villages to Revenue villages

Action Plan for the implementation of Forest Rights Act 2006 • Campaign drive for awareness generation as per the revised rules and support of the NGO/Agencies. • Necessary assistance of facilitators • Close monitoring on the progress of FRA implementation at various level • Conversion of Forest Village to Revenue Village • Videography of the gram sabha meeting for transparency and minimizing the disputes

  10. Contd. • Rejection of claim to be communicated to the claimant and opportunity to appeal against the rejection • Capacity Building at every level • GIS Mapping of villages • Appropriate decision and procedure for recording rights for title given under FRA
