    2. THE LDS CHURCH Taught polygamy in Missouri and Illinois In 1847 moved west to get out of the United States Mexican War 1850 Utah became a U.S. Territory

    3. Congress Has Constitutional Authority To Enact Laws Governing Territories The Morrill Act (1862) made bigamy in a territory a crime punishable by a fine and five years in prison. (Few were prosecuted for bigamy because the government had difficulty obtaining testimony about plural wedding ceremonies.) The Poland Act (1874) revoked Utah county probate courts' jurisdiction in criminal and civil affairs with the exception of divorce cases.

    5. The Edmunds Act (1882), barred persons living in polygamy from jury service, public office, and voting. It also made bigamous cohabitation, a misdemeanor, which made prosecution much simpler since proving cohabitation was easy, and over 1,300 Latter-day Saints were jailed as "cohabs" in the 1880s. The Edmunds-Tucker Act (1887) disincorporated both the Church and the Perpetual Emigration Fund on the ground that they fostered polygamy. revoked the probate courts' jurisdiction over divorces. authorized seizure of Church real estate not directly used for religious purposes, and acquired in excess of a $50,000 limitation imposed by the Morrill Act.

    6. THE MANIFESTO September 24, 1890, President Wilford Woodruff, issued the Manifesto discontinuing the practice of plural marriage and formally stating his counsel to Latter-day Saints to abide by antibigamy laws (see D&C Official Declaration1).

    7. Congress passed a final federal antibigamy provision in 1892, which excluded polygamists from immigration into the United States. This exclusion remains part of the U.S. Immigration and Naturalization Code. Utah added the antibigamy provisions into its state constitution as required by Congress for admission to the Union.

    8. Utah Constitution Article III, Section 1 First:Perfect toleration of religious sentiment is guaranteed. No inhabitant of this State shall ever be molested in person or property on account of his or her mode of religious worship; but polygamous or plural marriages are forever prohibited.

STATE V RODNEY HOLM 2002 Ruth Stubbs was born 7/21/82 Father David Stubbs; mother Sally Stubbs both fundamentalists and legally married to each other; David had 2 additional plural wives but one left and one died. David Stubbs part of first lawsuit against FLDS Church successfully suing for property rights and now considered an apostate by FLDS Ruths education level 6 th grade Has 18 full-blood siblings

    29. Rodney Holm was born 7/29/66 (twice the age of Ruth) His father, Carl, was one of the founders of the FLDS group Raised in polygamy Became a police officer in Arizona and cross-designated in Utah (so worked as police officer in Hildale and Colorado City)

    30. On 12/11/98, Ruth and Rod were wed (Ruth was 16; Rod Holm was 32) after Rulon Jeffs told her she should marry him. Her sister, Susie, pressured Ruth against her mothers as well as another siblings wishes. Ruth immediately becomes pregnant. Ruth has 2 kids and pregnant with her 3rd when she decides to flee in 2001.

    33. Utah Supreme Court upheld conviction, 2006 Court held that Holms behavior falls squarely w/in the realm of the States bigamy statute and that the protections enshrined in the federal constitution, as well as the state constitution, guaranteeing the free exercise of religion and conscience, due process, and the freedom of association do not shield Holms polygamous practices from state prosecution. The Court also found that the trial court appropriately exercised jurisdiction over the unlawful sexual conduct charges and that the states unlawful sexual conduct statute is constitutional.

Why people stay and obey the prophet in the FLDS The prophet decides who gets married as well as who gets more than one wife (need 3 to get to celestial kingdom) The prophet receives all tithing and can order extra payments whenever he needs the money The trust, which he headed until the court recently removed him as trustee, owned all the property in Hildale and Colorado City as well as most of the businesses

Therefore, it is necessary to obey him for eternal salvation, no questions asked If a man falls out of favor with the prophet or questions or disobeys the prophet, the prophet can take away his wives and children and reassign them to another man. The man will lose his job because the FLDS controls all the jobs; and he will lose his house because he doesnt own it. He loses EVERYTHING POWER, CONTROL, DOMINATION & FEAR REIGN SUPREME

State v David Kingston case no 981915218 John Daniel Kingston encouraged his daughter, Mary Ann, to marry her uncle, David,(becoming his 15th wife) which is why she ran away and later received the beating from her father David charged in Salt Lake County with incest and unlawful sexual conduct with a 16 or 17 year old

After spending some time in prison, David Kingston appeared before the Board of Pardons at his parole hearing and told them hed learned his lesson; Board of Pardons later released him from prison and terminated their jurisdiction of his casehe was not ever placed on parole to ensure that he would not engage in similar behavior

STATE V JOHN DANIEL KINGSTON Case No 981100400 John Daniel Kingston charged with 2nd degree felony child abuse for beating his then minor daughter, Mary Ann, on or about 5/22/98 in Box Elder County, UT. Kingston plead No Contest to 3rd degree felony and was sentenced to 0-5 years USP suspended, 196 days jail some of which may be suspended if Kingston makes a true apology to victim, restitution, probation to APP & anger mgt course

STATE V JEREMY KINGSTON - 2003 LuAnn Kingston (DOB 10/22/79) was Jeremys aunt as well as his first cousin (Jeremys mother and LuAnns mother are sisters; Jeremys grandfather is LuAnns father) LuAnn was counseled by her religious leader to marry Jeremy; married in religious ceremony on June 16, 1995 when LuAnn was 15 years old and Jeremy had just turned 24; she became his 4th wife LuAnn fled with her 2 children in May, 2000 LuAnn had only 9th grade education

JUVENILE COURT CASE John Daniel Kingston: DOB 5/13/55 Heidi Mattingly (DOB 7/ 7/ 71) married JDK when she was about 16 years old Heidi was raised in the Kingston social and religious order even though her parents, themselves, were not polygamists. They have 11 children Two of their children, teenagers, S.K. and A.K., were on the receiving end of JDKs wrath for getting their ears pierced in February, 2004. Fearing she would be physically injured, S.K. fled to a corner gas station and an employee called the police Another relative sought a protective order on the girls behalf and that launched an investigation by DCFS.

Guardian ad Litems office filed petition for abuse and neglect in Juvenile Court on behalf of the Kingston kids Court found : JDK & Heidi abused and neglected their children and that Heidi appears to be a victim of domestic violence from JDK Both later relinquished parental rights to oldest 2 children who have been adopted; court returned 8 kids to them (1 never removed)

    56. MaryAnn Kingston v. Kingstons, et al civil #030917113 PI The suit, filed Aug. 1, 2003, in 3rd District Court, names more than 240 people and nearly 100 businesses run by family members who make up the Latter-Day Church of Christ as defendants

    57. The suit's claims include intentional sexual abuse of a child; intentional infliction of emotional distress on the part of Mary Anns father, uncle, immediate family members and the 1,200-member clan itself; and assault, battery and false imprisonment. Among other things, it seeks punitive damages of $100 million and compensatory damages of $10 million, along with payment for Mary Ann Kingston's medical and psychological treatment and legal fees

Owen Allred and the The AUB have been sued civilly In 1997, Virginia Hill filed a multi-million dollar lawsuit against Allred, et al, claiming that the AUB conspired to steal money from her and that the church laundered thousands of dollars that belonged to her ($1.54 million in cash). In 2003, the AUB was found liable but the case is not yet resolved, even today.

He had 2 of his wives carry out the murder; one of them was acquitted and later wrote a book acknowledging her role in the murder Group still violent though loosely organized..some members recently put on MOST WANTED list
