  2. Is implemented based on: The Sentence Execution Code of Latvia (with amending laws of 11.08.2011., 01.10.2011, 30.12.2011., 11.01.2013., 01.04.2013.) Cabinet Regulations No. 191 “Convicted person’s resocialization implementation arrangements” from April 9, 2013 Convicts risk and needsevaluation

The task of criminal punishment execution is: to execute criminal punishment in accordance with the fundamental principles provided in the Code applying the resocialisation measures laid down in the Code to a convicted person, as well as to achieve that the convicted person and other persons abide laws and refrain from committing criminal offences. Within two months after placing a convicted person in the prison the head of the institution shall ensure an assessment of the risks and needs of the convicted person, determining: 1) the resocialisation needs of the convicted person, the degree of risk of anti-social behaviour and committing a repeated criminal offence in the deprivation of liberty institution; 2) the most appropriate social behaviour correction or social rehabilitation measures and other measures to be implemented during execution of the sentence and to be included in the resocialisation plan of the convicted person (The Sentence Execution Code of Latvia Section 61.5 first part) The risks and needs of a person sentenced with temporary prison service shall be identified within two weeks after his or her placement in the prison (The Sentence Execution Code of Latvia Section 61.5 fifth part) Riskandneedsassesmentimplementationarrangements

At the end of the evaluation process all the professionals involved (senior inspector, social worker, psychologist) performs a situation analysis, risk and the needs overall assessment and planning ofthe resocialization measures were convicted person will be involved during the penalty execution, in accordance with: specific needs termofthesentence RiskandneedsOverallassessment

Resocialization plan is based on the results of the convicts risks and needs assessment (Cabinet Regulation No. 191, paragraph 20) Resocialization objective are defined in resocialization plan as well as the relevant tasks for full term custodial sentences Resocialization plan provide the resocialization measures, as well as deadlines for their execution (Cabinet Regulations No. 191, paragraph 22) Resocializationplanofconvict

Resocialization plan is updated on the basis of results of convicts repeated risk and needs assessment resocialization results of the previous evaluation period (Cabinet Regulation No. 191, paragraph 21) Deciding the question of convicts penalty execution progress in progressive penal execution system - penalty execution commutation regime or convicts possible conditional release, staff evaluates the convicts resocialization plan execution and results (Cabinet Regulation No. 191, paragraph 25) Resocializationplanofconvict

One month before the date on which the convict acquires the right to ask for conditional release, resocialization officer evaluates convict resocialization results, as well as determine antisocial behaviour and criminal offense recidivism risk and gives Prisons Administrative Commission opinion about the convicts possible conditional release from serving the sentence (Cabinet Regulation No. 191, paragraph 26) Convicts resocialization results evaluation procedure
