  3. PURPOSE To brief the Portfolio Committee on Communications on the establishment of the South African Broadcast Production Advisory Body.

  4. CONTEXT • Section 38 of the Broadcasting Act 4 of 1999 as amended, tasks the Minister to establish a South African Broadcast Production Advisory Body (SABPAB) (“the Advisory Body”) to advise her on how the development, production and display of local television and radio content can be supported. • The Broadcasting Digital Migration (BDM) Policy:- • Provides for new additional television channels; • Highlighted that compelling content as a major driver of digital terrestrial television (DTT) take-up; and • Provides for the establishment of content generation hubs (CGHs).

DEFINING LOCAL AND DIGITAL CONTENT • Local Content refers to the texts, images (moving and/or still) that is of cultural or creative in nature that is written, presented, produced and/or otherwise contributed to and owned by persons from South Africa transmitted over electronic platforms. • Digital content refers to what is defined as “any sound, text, still picture or other audio-visual representation, tactile representation or any other preceding, which is capable of being created, manipulated, stored, retrieved or communicated electronically” (Malaysia’s Communications and Multimedia Act ,1998).

OVERVIEW OF THESA CONTENT INDUSTRY • It is estimated at R3 billion; • Dominated by a few companies; • Lack of comprehensive support mechanism for aspirant and emerging content creators; • Commissioning–driven nature of South African content industry; • Limited platforms available to distribute this content; • Skills shortage relating to script development and packaging; • Lack of access to a robust and reliable infrastructure to encourage content development, and • The concentration of content development activities in urban centers, particularly Johannesburg and Cape Town.

FUNCTIONS OF THE SABPAB • To advise the Minister on how to encourage, facilitate and offer guidance and advise in respect of any scheme and to promote:- • the production of broadcast materials that meet the cultural needs of South Africans; • the screening and airplay of South African content in television and radio; • awareness of local content in South African and foreign markets; • distribution and exhibition of local content in foreign markets; • the correction of imbalances in the local content production industry; • how to encourage and facilitate the development of policy, strategy and legislation to combat the distribution of illegal or harmful content; • human resource development to provide skills and training of local content providers; and • co-productions and concluding international agreements.

FUNCTIONS OF SABPABcont… • The Body must after consultation with the National Film and Video Foundation and the broadcasting industry make recommendations for the Minister to determine after consultation with Ministers of Arts and Culture, Science and Technology, Trade and Industry and Finance- • policy and strategies to give effect to the production and display of local content; • financing strategies to support the production and display of local content; • supply-side measures and initiatives to support the production of local content; and • policies to enhance the production of local content for the multi-channel and digital broadcasting environment; and • policy and strategies to give effect to local and digital content development.

  9. FUNDING AND RESOURCES • The Department shall fund the activities of the Advisory Body. • The Advisory Body may also be funded from donations, grants and voluntary contributions from industry and other interested parties.

  10. COMPOSITION • Consists of six (6) members appointed by the Minister in a manner ensuring— • participation by the public in a nomination process; and • transparency and openness. • Appointment to be published in the Gazette. • The Minister to appoint the Chairperson of the Advisory Body. • The members of the Board must, when viewed collectively— • be persons who are citizens of the Republic; • be persons who are committed to fairness, freedom of expression, the right of the public to be informed, and openness and accountability on the part of those holding public office; • represent a broad cross-section of the population and different regions of the Republic; • members from government, the regulator, consumer groups, broadcasters, content creators, producers, and distributors who possess suitable qualifications, expertise and experience in, amongst other things, broadcasting, electronic engineering, economics, consumer issues, Intellectual Property (IP), content regulation, cyber crime and local and digital content.

  11. TERM OF OFFICE • A member of the Advisory Body holds office for a period of 5 years and is eligible for re-appointment on expiry of his or her term of office, but may not serve more than two consecutive terms of office. • The Advisory Body to appoint or abolish such committees as may from time to time seem desirable for the more effective functioning of the Advisory Body. • Once the Advisory Body is established it must appoint a sub-committee responsible for providing advice on strategies to give effect to local and digital content development and cyber crime.

  12. REMOVAL FROM OFFICE • A member of the Advisory Body vacates office if that member is removed from office by the Minister as contemplated in sub-paragraph below; or resigns by written notice addressed to the Minister. • The Minister may remove a member of the Advisory Body for serious misconduct; permanent incapacity; engaging in any activity that may undermine the functions of the Advisory Body and absence from three consecutive meetings of the Advisory Body: • without the prior permission of the Advisory Body; or • unless the member shows good cause; or • If the chairperson or a member of the Advisory Body vacates office before the expiry of the period of office, the Minister must appoint a new chairperson or member, as the case may be, for the unexpired portion of that period within 90 days.

  13. MEETINGS • Meetings to be held at least four (4) times a year at a time and place as may be fixed by the members or the Chairperson. • In the absence of the Chairperson or deputy Chairperson members present may choose one of the members to preside for the purposes of that meeting. • Meetings of members shall be governed by a majority vote of voting members present at any duly convened meeting, provided that a quorum of one-third (1/3) of the voting members are present at that meeting. • In the case of an equality of votes, the Chairperson of the meeting at which the show of hands took place, is entitled to a second or casting vote. • Members shall personally attend meetings.

  14. SECRETARIAT • All administrative, financial and logistical matters related to the Advisory Body’s work will be managed by a dedicated Secretariat provided by the Department. • The Department will appoint an administrator responsible for co-coordinating the functions of the Secretariat and supervising the staff of the Secretariat. • The Secretariat is responsible for overall administrative support to the Advisory Body including: • organising the meetings; • taking minutes of meetings; • managing the day to day administrative affairs; and • logistical arrangements.

  15. REMUNERATION • A member of the Advisory Body who is not in the full-time employment of the State may be paid the remuneration and allowances determined by the Minister with the approval of the Minister of Finance in accordance with National Treasury Regulations

PROGRESS & WAY FORWARD • Notice to invite the public to nominate people to serve in the Body published. • Once the nominations have been received, Minister to establish a Committee to recommend names for appointment. • Appointed names to be published in a gazette. • The immediate task of the Advisory Body will be to review the draft Local and Digital Content Strategy. The objectives of the strategy are to:- • grow the local content industry in SA; • allow the entry by emerging content creators, particularly from historically disadvantaged background; • unlock the potential of the content industry in SA to create jobs;

PROGRESS & WAY FORWARDcont… • create a highly competitive content industry that has a strong export potential, in accordance with the National Industrial Policy Framework; • use content development as a vehicle to foster regional integration; • position the country as a regional Content Hub; and • enhance the value of Public Sector Information (PSI)
