Consideration of a Revised Investment Policy for Endowed Chair, Professorship, and Scholarship Programs • More closely aligns with the federal Uniform Prudent Management of Institutional Funds Act (UPMIFA) • Provides for more flexible spending of program assets • Provides limited additional flexibility in investment portfolio allocations • The Board of Regents Investment Policy is more conservative than the provisions of UPMIFA • The Investment Policy still maintains that no spending is allowed if the market value of program assets is below the original corpus • The minimum value of funds that must be invested in fixed income instruments remains at 26% • There is no change in fiduciary responsibility held by all parties involved in the management of Board of Regents endowment funds.

RECOMMENDATION Senior Staff recommends Committee approval of the Small Capital Projects Report as presented in the consent agenda. • Soccer Facility Nicholls State University (Reapproval) $480,000 from Other Funds • Dean Lee Research Station New Greenhouses Louisiana State University Agricultural Center $215,000 from Self-Generated and Grant Funds

  10. Agenda Item IV. Lease • Louisiana State University and A&M College – Lease of premises adjacent to Tiger Stadium to the Tiger Athletic Foundation (TAF) for the purpose of constructing site improvements including entry plaza, gateways, landscaping, and a Champion’s Plaza. Total funding of $7,000,000 with $5,833,334 of that for construction, will come from private donations. Upon completion of the work, the improvements will be donated to LSU and the lease will terminate. A maintenance reserve account of 10% of the cost of construction will be provided.

  11. RECOMMENDATION Senior Staff recommends Committee approval of the lease requested on behalf of Louisiana State University and A&M College relating to the construction of Tiger Stadium site improvements.

  22. Agenda Item IV. R.S. 17:1808 (Licensure) • Proposed Amendment to Rules and Regulations for the Administration of R.S. 17:1808

Proposed Amendments to Rules and Regulations for Administration of R.S. 17:1808 • In 2010-2011, the Board of Regents amended its Rules and Regulations for the Administration of RS 17:1808 to include additional regulations for those institutions offering either Teacher Certification or Education Leadership programs to Louisiana residents. • Administration of the amended regulations proved that the purposes of the amended regulations could be served by requiring institutions to hold national accreditation (NCATE or TEAC), rather than accreditation in addition to other documents and processes.

For all courses/programs for teachers and educational leaders (e.g., teacher leaders, principals, school/district supervisors, superintendents, etc.), provide evidence of attainment of national accreditation (e.g., National Council for Accreditation of Teacher Education - NCATE; Teacher Education Accreditation Council – TEAC). • F. For all face to face teacher/leader courses/programs with or without clinical experiences in Louisiana and all on-line teacher/leader courses/programs with clinical experiences in Louisiana that result in initial teacher or leader certification being placed on teacher/leader certificates in Louisiana, provide evidence of the pursuit or attainment of national accreditation by the National Council for Accreditation of Teacher Education (NCATE) or Teacher Education Accreditation Council (TEAC) and provide evidence of attainment of Level 1 Approval to implement a program for initial certification of teachers and/or certification of educational leaders. (Bulletin 996 B Standards for Approval of Teacher and Educational Leadership Preparation Programs). Also, provide evidence of intent to adhere to the requirements of the State teacher and/or educational leadership accountability systems. • G. For all face to face teacher/leader courses/programs with or without clinical experiences in Louisiana and all on-line teacher/leader courses/programs with clinical experiences in Louisiana that do or do not result in add-on certifications/endorsements being placed on teacher/leader certificates in Louisiana, provide evidence of the pursuit or attainment of national accreditation by the National Council for Accreditation of Teacher Education (NCATE) or Teacher Education Accreditation Council (TEAC).

Rulemaking Timetable for the Month of Januarycont’d(Section citations refer to the APA) Footnotes: 1.   Report includes (1) summary of testimony at agency's public hearing; (2) summary of comments received; (3) copy of response to comments prepared by agency; (4) statement of tentative/proposed action by agency on oral/written comments received; (5) revision of proposed Rule or statement that no changes have been made; (6) concise statement of reasons for/against adoption/amendment of changes suggested. 2.   Oversight committee hearing shall be held no earlier than 5 days and no later than 30 days following the day the agency turns in its report. 3.   If agency has decided to make substantive changes to the proposed rule text, it should wait until after it holds a hearing on substantive changes before turning in its report as shown in Footnote 1 above. When holding a substantive change hearing, the agency must advertise the hearing date in the Louisiana Register (Potpourri Section) 30 days prior to the hearing.

  27. RECOMMENDATION Senior Staff recommends Committee approval of its intent to amend the Rules and Regulations for the Administration of R.S. 17:1808 regarding requirements for Teacher Education and Education Leadership programs and initiate the APA process.

House Concurrent Resolution 121 of the 2011 Regular Session of the Louisiana Legislature • Legislature requests the Board of Regents to: • Fully implement admission standards; • Ensure that developmental education and associate degree programs be delivered by two-year institutions; • Include certain concepts in its Master Plan; and • Expand and publish certain data.

RECOMMENDATION Senior Staff recommends that the Committee approves and endorses the response to HCR 121 of the 2011 Regular Legislative Session, and authorizes the Commissioner of Higher Education to make whatever editorial and other non-substantive changes necessary prior to its transmittal to the appropriate House and Senate Committees.

House Concurrent Resolution 30 of the 2011 Regular Session of the Louisiana Legislature Legislature requests the Board of Regents: “… to study the provision of public postsecondary educational opportunities throughout the state, to establish the appropriate role, scope, and mission of each public postsecondary education institution, and to formulate a plan that will make optimal use of all available academic, fiscal, and physical resources… “… recognize the unique nature of each institution, and allow each institution's students to successfully and efficiently pursue their chosen academic path” … “…that this study shall be based upon best practices for the development of a world class, integrated education delivery system,” without allowing “the historic missions of the institutions and the existing relationships between the institutions to prejudice the conduct and conclusions of the study.”

In The Area of Making Optimal Use of All Available Academic Resources • HCR 121 (Carter) – Request the Board of Regents to complete and submit the Master Plan for Postsecondary Education in Louisiana and fully implement admissions standards. • HB 419 (Smith) – Established the Remedial Education Commission.. • HR 50 (Harrison) – Study the structure and operations of LUMCON • HCR 23 (Smith) – Study issues related to funding and the impact of dual enrollment programs • HCR 184 (Carmody/Schroder) – Created a Commission to study (1) A plan for the reorganization of the governance, management, and supervision of postsecondary education, (2) Recommendations for the proper mechanism for setting tuition and suggestions regarding the proper balance of state general funds and tuition as means of funding postsecondary education, and (3) Proposals regarding the distribution formula of state general funds and the relative importance of equity and performance in that formula.

  39. Remaining HCR 30 issue to be addressed is “To establish the appropriate role, scope, and mission of each public postsecondary education institution.”

R.S. 17:3218 R.S. 17:3128 requires that “After consultation with each postsecondary education management board, the chancellor, and the president of each public institution of postsecondary education, the Board of Regents shall devise, describe, and establish a mission for each … institution within each system.”

RECOMMENDATION Senior Staff recommends that the Committee receive the staff update regarding HCR 30 of the 2011 Legislative Session and direct the staff to complete its work with the systems and campuses on role, scope and mission statements in time for Board consideration at its February meeting.
