  1. Clean Water Act Section 319 Clean Water Act (CWA) Section 319 requires States to form a Nonpoint Source Program and authorizes Congress to provide funds for grants to the State. The goal is to protect and restore waters that are threatened or impaired by nonpoint source pollution.

  3. General conditions • 60% Federal Funds maximum • 40% Match • 10% Administration maximum • 20% Cap on non-implementation • Must be related to nonpoint source water quality issues.

Grant types • Nonpoint Source Program Grants, funds program staff, operating costs and supports other NPS Programs. • Additional Grant Opportunities (AGOs) are smaller grants intended to spread funding opportunities to as many projects as possible. • Watershed Project Grants are tied to the 303(d) list and TMDL implementation.

Timelines • AGOs are variable; announcements only occur if monies are available within a particular budget year. • Nonpoint Program and Watershed Project grant proposals drafts are due to DEP on June 1. • The State usually sends its entire grant to EPA by mid August. • The State receives comments back from EPA usually within two months; depending on the information requested it may take several months to correct and re-submit the grant application.

  8. Grant awards • The Award is usually received from EPA by late spring or early summer depending upon many factors of the review process, the federal budget etc. • The State issues sub-grants to partners that submitted watershed project proposals as well as sub-grants to our agency partners that support the mission of the NPS Program. • 319 Grants are five years in length; however only four years is available for implementation. They must be completed before Sept. 30th of the last year.

Reporting Two Semi-Annual progress reports are required per year for all watershed project and AGO awards. • The 1st period is (Oct. 1 - March 31), the report due May 1. • The 2nd period is (April 1 - Sept. 30), the report due November 1. • A Final Report is required when the grant is completed.
