FCC Number vs DA Number on Orders • Decisions are issued in two different ways: by the authority of the entire Commission, with each Commissioner voting; or by authority delegated to the Bureaus and Offices of the Commission. • If the decision is one decided by the Commission, it is identified by an FCC number. The FCC number is comprised of two digits indicating the year, and a number of up to 3 digits indicating the sequence, such as FCC 08-138. • If the decision is one issued through authority delegated to the FCC Bureaus and Offices, it is identified by a DA number. The DA number is constructed similarly to an FCC number, with two initial digits indicating the year, and a number of up to 4 digits indicating the sequence such as DA 08-1476.   8. Order FCC 13-82Released June 10, 2013 In this Order, the FCC adopted comprehensive reforms to the VRS program. Measures to reform the program include: • promoting the development of voluntary, consensus interoperability and portability standards; • creating a centralized TRS User Registration Database to combat fraud, waste, and abuse; • encouraging competition and innovation in VRS call handling services; and • spurring research and development in VRS services by entering into a Memorandum of Understanding with the National Science Foundation. The Order also indicates the FCC will move VRS compensation rates toward actual costs over the next four years, initiating a step-by-step transition from existing tiered TRS Fund compensation rates toward a unitary, market-based compensation rate. Order DA 13-1488Released July 2, 2013 • The FCC announced the allocation of $9.5 million in 2013–2014 funding for programs in each state that distribute communications equipment to low-income deaf-blind individuals. • The certified program in each state, as well as in the District of Columbia, Puerto Rico, and the U.S. Virgin Islands, receives a base amount $50,000 plus a portion of the remaining amount proportionate to the population of the jurisdiction it serves. • The allocation is part of the pilot National Deaf-Blind Equipment Distribution Program established by the FCC in 2011 to implement section 105 of the Twenty-First Century Communications and Video Accessibility Act (CVAA). • State NDBEDP Certified Program Funding Allocation for 2012-2013 Florida - Florida Telecommunications Relay, Inc. $463,782 • State NDBEDP Certified Program Funding Allocation for 2013-2014 Florida - Florida Telecommunications Relay, Inc. $466,527 TASA Meeting – October 25, 2013

Order DA 13-1530Released July 8, 2013 • The FCC grants a 5 year certification to the Florida TRS program pursuant to Title IV of the Americans with Disabilities Act (ADA), 47 U.S.C. § 225(f)(2), and section 64.606(b) of the Commission’s rules. On the basis of the Florida application received, the FCC determined that: • (1) The Florida TRS program meets or exceeds all operational, technical, and functional minimum standards contained in section 64.604 of the Commission’s rules; • (2) The Florida TRS program makes available adequate procedures and remedies for enforcing the requirements of their program; and • (3) The Florida TRS program in no way conflicts with federal law. Order FCC 13-101Released July 19, 2013 TASA Meeting – October 25, 2013 On July 19, 2013, the FCC adopted a Report and Order amending rules to improve Speech-to-Speech (STS) relay service.  By this Order, the FCC’s action improves the STS user’s experience on a call by: Increasing the time a communication assistant (CA) must stay with a call from 15 minutes to 20 minutes; Allowing STS users the option to mute their voices during an STS call; and Ensuring that STS users who dial 711 have the same ease of reaching an STS CA as users of other types of TRS. In addition to the order, the FCC issued a Further Notice of Proposed Rulemaking (FNPRM), seeking comments on several issues, including: Whether to contract for a national STS outreach coordinator to conduct all STS outreach; Whether to adopt consumer registration for STS; and Whether to adopt other recommendations made by consumers to improve STS, such as the use of caller profiles that provide CAs with information about the communication preferences of STS users in advance of calls.

Order FCC 13-118Released August 26, 2013 • Misuse of Internet Protocol (IP) Captioned Telephone Service Paragraph 96 • We continue to believe that, given the unusual characteristics of IP CTS relative to other relay services, it is reasonable and prudent to require that equipment, software, and mobile applications used in conjunction with IP CTS have a default setting of “captions off” at the beginning of each call, so that the consumer must take an affirmative step to turn on the captions each time the consumer wishes to use IP CTS. Paragraph 137 • Given that the original reasons for having the Fund provide compensation for these calls may no longer exist, we believe that the Commission should reconsider its prior decision to treat IP CTS as an entirely interstate service and propose instead that this service be treated like traditional CTS, wherein state relay programs would be required to compensate providers for intrastate IP CTS calls... Paragraph 138 • Mandating CTS and IP CTS. While every state voluntarily offers CTS, the Commission currently does not mandate the provision of either CTS or IP CTS. Given that we are now proposing to shift some of the financial obligations associated with IP CTS to the state programs, we seek comment on whether a mandate is needed to ensure that all states will participate in the provision of these services.   13. Order FCC 13-127Released September 30, 2013 On September 30, 2013, the FCC released an Order on Reconsideration to clarify the text-to-911 “bounce-back” requirement when consumers are roaming (traveling outside of the consumer’s home wireless service network). In the previously released May 2013 Bounce-Back Order, the FCC required providers of messaging services to provide an automatic “bounce-back” text message when a consumer attempts to send a text message to 911 in a location where text-to-911 is not available. The bounce-back requirement has been amended to specify that when a consumer attempts to send a text to 911 while roaming, the provider offering roaming service (host provider) satisfies its bounce-back obligation if it does not impede the ability of a consumer’s text to reach the consumer’s home network provider (home provider) or impede any bounce-back message generated by the home provider from going back to the consumer. 

  14. PSC Updates • By Order No. PSC-13-0240-PAA-TP, issued June 3, 2013, the Florida PSC approved FTRI’s 2013-2014 fiscal year budget. The PSC approved FTRI operating revenue of $8,771,408 and expenses of $10,110,295. TASA Meeting – October 25, 2013

IP CTS Comments filed by PSC on September 27, 2013 • The FPSC encouraged the FCC to consider the following: • The FCC should provide Internet Protocol Captioned Telephone Service minutes and number of Internet Protocol Captioned Telephone Service units by state as soon as possible so states can make informed decisions on possible migration of Internet Protocol Captioned Telephone Service to state relay programs; • If state funding of intrastate Internet Protocol Captioned Telephone Service is mandated, it should not occur until the FCC is assured that problems noted in the Internet Protocol Captioned Telephone Service Interim Order are corrected; • The jurisdictional separation issues in Docket No. WC 04-36 (IP-Enabled Services) must be resolved before determining the jurisdiction and associated funding of Internet Protocol Captioned Telephone Service; • If a decision is made to require states to assume intrastate Internet Protocol Captioned Telephone Service costs, the FCC must allow time for states to make legislative changes; and, • Mandating Internet Protocol Captioned Telephone Service as part of the TRS program may eliminate competition for these services in Florida since, by statute, Florida can have only one relay service provider. • http://apps.fcc.gov/ecfs/document/view?id=7520945988 TASA Meeting – October 25, 2013

  17. 2013 Relay Report Section 427.704(9), Florida Statutes “The commission shall prepare an annual report on the operation of the telecommunications access system, which shall be available on the commission’s Internet website. Reports must be prepared in consultation with the administrator and the advisory committee appointed pursuant to s. 427.706. The reports must, at a minimum, briefly outline the status of developments in the telecommunications access system, the number of persons served, the call volume, revenues and expenditures, the allocation of the revenues and expenditures between provision of specialized telecommunications devices to individuals and operation of statewide relay service, other major policy or operational issues, and proposals for improvements or changes to the telecommunications access system.” Florida PSC TASA Meeting – October 25, 2013 17

Legislative Update TASA Meeting – October 25, 2013 HB 1135/SB 1688 - Telecommunications Access System: Revises powers & duties of PSC; requires that Commission establish recovery mechanism requiring commercial mobile radio service providers to impose monthly surcharge on their subscribers; revises provisions relating to administration; provides for distribution of wireless mobile devices; revises membership of advisory committee that assists commission; requires that commission ensure public safety & health care providers are complying with requirements to purchase & operate telecommunications devices.
