  2. Purpose of Meetings To receive input on desired or needed changes to Title 5 regulations to better support districts in their siting and design of safe and educationally appropriate schools.

  3. Why Reviewing? Changes are needed to: • Reflect current educational planning practices and standards • Consider recent educational program changes—Transitional kindergarten, project based learning • Clarify existing standards • Update to current codes and other citations

Education Code, Section 17251 (a)“…advise the governing board (of a school district) on the acquisition of new school sites…(and) give the governing board in writing a list of the recommended locations in the order of their merit, considering especially the matters of educational merit, safety, reduction in traffic hazards, and conformity to the land use element of the general plan…”

  6. Education Code, Section 17251 (cont.) (b)"...develop standards for use by school districts in the selection of school sites in accordance with the objectives set forth in subdivision (a).“ (c) “Establish standards for use by school districts to ensure that the design and construction of school facilities are educationally appropriate and promote school safety.”

Title 5 History & Overview • Present form adopted in 1993 • Last updated in 2000 • Applies to all district projects • Charter schools not subject to Title 5 • (except those requesting funding from State Allocation Board) • Contains prescriptive, performance and process standards • Exemption process

Next Steps • Through early part of 2017, CDE will host a number of stakeholder sessions throughout the state • CDE will review and consider all comments in its preparation of draft revisions to Title 5 • Request State Board of Education to open rule making process Summer/Fall 2017 (draft regulations made available - public comment period) • Office of Administrative Law (OAL)
