  1. TENTATIVE AGREEMENT &MEMORANDUM OF UNDERSTANDING VISTA TEACHERS ASSOCIATION

  2. YOU WILL BE MAKING RECOMMENDATIONS ON THE FOLLOWING TWO (2) DOCUMENTS: 1)THE TENTATIVE AGREEMENT &2) THE MEMORANDUM OF UNDERSTANDINGYOU WILL DECIDE WHETHER OR NOT VTA WILL CONDUCT A RATIFICATION VOTE FOR THE ABOVE TWO (2) AGREEMENTS

UNDERSTANDING THE DIFFERENCE BETWEEN THE TWO (2) DOCUMENTS THE TENTATIVE AGREEMENT If Rep Council recommends that the Tentative Agreement be sent to members for a ratification vote, the new language, once ratified by both VTA members and the VUSD Board, will beincorporated into and become a part of the VTA Collective Bargaining Agreement

UNDERSTANDING THE DIFFERENCE BETWEEN THE TWO (2) DOCUMENTS THE MEMORANDUM OF UNDERSTANDING If Rep Council recommends that the Memorandum of Understanding be sent to membership for a ratification vote, the new language, once ratified by VTA members and the VUSD Board, will not be incorporated into or becomea part of the VTA Collective Bargaining Agreement All new language will begin on: July 1, 2010, and sunset-permanently- on July 1, 2013

  7. ARTICLE 9-SEC 9.1EMPLOYEE RIGHTS/BARGAINING UNIT RIGHTS ADD THE FOLLOWING NEW LANGUAGE SEXUAL ORIENTAITON

  8. ARTICLE 12-SECTION-12.21.4SALARIES ADD THE FOLLOWING NEW LANGUAGE: Speech, Language and Hearing Specialists holding a Master’s Degree shall be on the same schedule (Appendix A-3) as Psychologists while serving in the Speech Language Specialist position

ARTICLE 18-SECTION 18.3.5INSTRUCTIONAL HOURS ADD THE FOLLOWING NEW LANGUAGE: By May 15th of each school year the District and Vista Teachers Association will meet and negotiate to determine the number of K-1 teachers release days to administer District Benchmark Assessments for the following year.

ARTICLE 19-SECTION 19.11TEACHERS’ SAFETY CONDITIONS OF EMPLOYMENT ADD THE FOLLOWING NEW LANGUAGE (UNDERLINED & IN RED): The administration shall establish a procedure to inform the teacher(s) of each student who has caused or attempted to cause serious bodily injury or injury to another person, sexual harassment as defined in California Education Code Section 212.5, or other acts described in Education Code Section 49079 (a)…..

ARTICLE 29STATE SUPPLEMENTAL INSTRUCTION PROGRAMS/SUMMER SCHOOL, BEFORE/AFTER, & SATURDAY SCHOOLS HIGHLIGHTS OF THE NEGOTIATED CHANGES: DELETE THE FOLLOWING SECTIONS: 1) 29.1.3.1 2) 29.1.3.2 3) 29.1.4.1 4) 29.1.4.2 5) 29.1.4.5 6) 29.2.1 7) 29.2.1.1 8) 29.2.1.2 9) 29.2.1.3 10)29.2.1 11)29.2.4-Total number of monthly instructional minutes x 125 = Preparation Time Compensation…

ARTICLE 29STATE SUPPLEMENTAL INSTRUCTION PROGRAMS/SUMMER SCHOOL, BEFORE/AFTER, & SATURDAY SCHOOLS Delete in Sections 29.1.3.1 and 29.1.4.1 the following language: First sentence: For every four (4) hours scheduled of summer school Entire second sentence: Additional instructional or work time will have a pro-rated break time based accordingly

ARTICLE 29STATE SUPPLEMENTAL INSTRUCTION PROGRAMS/SUMMER SCHOOL, BEFORE/AFTER, & SATURDAY SCHOOLS Add the following new language to Sections 29.1.3.1 and 29.1.4.1: If the schedule of summer school hours is at least four (4) hours and not more than five (5) hours there will be fifteen (15) minutes duty free non-paid break that will not count as work or instructional time. If the instructional day goes beyond five (5) hours, teachers shall have a forty (40) minute duty free non-paid lunch break.

  14. CONTENTS OF THE MEMORANDUM OF UNDERSTANDING

  15. ARTICLE 8TERM The Memorandum of Understanding will run through and end on: June 30, 2013

  16. ARTICLE 9-SECTION 9.10EMPLOYEE RIGHTS/BARGAINING UNIT RIGHTS The parties agree to reopen negotiations on Article 9, Section 9.10, at the conclusion of the arbitration

  17. ARTICLE 12SALARIES SUMMARY OF LANGUAGE: • 2010-11 Salary Schedule shall be reduced by 2.7% to reflect the five (5) day reduction in work year included in Article 17 • Estimated BRL per ADA for 2010-11 $4,962.83 shall be compared each year of contract period • In any year the BRL increases by at least $50 per ADA, the district shall reduce the number of furlough days by one (1) • Any reduction in furlough days shall be applied to the following and remaining years in the contract • In a year where the BRL is more than $50 but less than another increment of $50, amount above $50 will be applied the following year

ARTICLE 12SALARIES (continued) EXAMPLE: If in 2010-11 increase to the funded BRL is $75: • 2010-11 one (1) furlough day is returned & 0.54% (based on 2009-10 salary schedule) is restored to the salary schedule $75 (MINUS) $50= $25 to be applied to 2011-12 2011-12 increase to the funded BRL= $75/ $25 + $75 =$100 • Therefore in 2011-12 two (2) furlough days are returned & 1.08% (based on 2009-10 salary schedule) is restored to the salary schedule

ARTICLE 12SALARIES (continued) • The dollars generated from the BRL per ADA shall first be used to restore the five (5) day reduction in the work year specified • Each additional $50 above the amount necessary to restore the five (5) furlough days shall increase the salary schedule by 0.54%, not limited to $50 increments For example: $75 would result in a 0.81% salary increase • If the federal government provides funding specifically directed to job creation or retention, parties agree to reopen negotiations to discuss the effect

  20. ARTICLE 17WORK YEAR 2010-2011 & 2011-12 Five (5) less instructional days-teachers contract year and pay will be reduced by these five (5) days 2012-13 Five (5) days will be restored to the teacher’s work year along with the pay for these days

  21. ARTICLE 18-SECTION 18.3.3INSTRUCTIONAL HOURS HIGHLIGHTS OF NEW LANGUAGE: • Lengthens the elementary student/teacher contact day four (4) days a week • Shortens the student/teacher contact day one (1) day a week for the purpose of staff planning meetings • Section does not apply to pre-school • Time will be used for teacher collaboration which may consist of grade level meetings, data reporting/analysis, and/or professional development • Time may also be used for certificated staff in collaboration teams to analyze their professional practices to improve individual & collective student achievement • Collaboration day Wednesday- no make-up for school closures • Expires end of 2010-11 school year unless parties mutually agree in writing to extend this section

  22. ARTICLE 20CLASS SIZE 2010-11 & 2011-12 • Grades 1-3: Average class size will be 24.94 2012-13 • Grades 1-3: Average class size will revert to currentcontract language unless the State revises the program in which case there shall be a reopener

  23. ARTICLE 20CLASS SIZE (continued) 2010-11, 2011-12 & 2012-13 Middle School Maximum daily student contact for teachers: 213 Maximum class size not to exceed: 37 High School Maximum daily student contact for teachers: 188 Maximum class size not to exceed: 39

  24. ADDITIONAL ITEMS MEMORANDUM OF AGREEMENT • Parties agree to incorporate all previous tentatively agreed upon Articles and continue current language for all other Articles 2. Effective date of this Agreement will be: July 1, 2010
