Situation of the European Gas Market – Evaluation of the Madrid Gas Forum • No effective competition of supply side • No clear, transparent and harmonized access rules to network (in some cases negotiated TPA) • Dominant players on the European and on local market (through mergers, acquisition) • Different level of network tariffs • Commercial congestions, bottlenecks at cross border • Take or pay, long term contracts • The financial framework (security) for new network and storage investment is not clear 9

Conditions of effective competition Access to the networks, storage, system servicesand to information • Some elements of Good TPA Practice is missing (clear definition of available capacities; effective management separation; gas secondary market;but prepared Codes) • Cross border capacity auctions , but for very limited available capacity(at gas the eastern connection is overbooked and the western connection /at Baumgarten/ is more expensive) • Weak rules on non-discrimination (preference for incumbent „public wholesaler, public suppliers”), weak promotion of new traders /lack of available capacity at eastern connection and at storage/ • Scarce cross border capacities and storage facilities in the gas transmission system (TSO – Regulator debate on future demand, on available capacities, on necessary developments) • Adequate network charges (Postage stamp method at present; preparation of Entry – Exit tariff for 2005) 11
