Areas/Sites Violating Revised (2006) 24-Hour PM2.5 NAAQS (based on 2004-2006 data) • Current nonattainment area (NAA) violates 24-hr NAAQS [29 areas] • Current NAA meets 24-hr NAAQS [10 areas] • Sites in current NAA violate the 24-hr NAAQS [131 sites / 29 areas] • Sites not in a current NAA violate the 24-hr NAAQS [48 sites / 32 areas]

CAIR Vacatur • CAIR in effect since June 2006 • EPA was sued by a small number of parties (one state, less than 20 power companies, and two small trade associations) on various aspects of CAIR • The Court issued its decision on July 11, 2008 to vacate both CAIR and the FIP in their entirety and sent the rules back to EPA

New Locomotive and Marine Diesel Rule • March 14, 2008- final rule issued • Reduce PM by 90% / NOx by 80% when implemented • Tightens standards for existing engines when remanufactured • Standards for new engines reflecting current emission reduction technologies • Locomotive idle reduction requirements • ULSD fuel (15 ppm) required in 2012

Mandatory GHG ReportingRulemaking • Objective - To collect comprehensive and accurate data relevant to future climate policy decisions, including potential future regulation under the Clean Air Act • Scope of Coverage - Define gases “…to require mandatory reporting of greenhouse gas emissions” (CO2, CH4, N2O, HFC, PFC, SF6) • Sections 114 & 208 of the CAA allow for data collection, measurement & recordkeeping from stationary or mobile related sources • Proposed rule expected by September 2008 and final rule by June 2009 • EPA welcomes stakeholder input and plans to reach out to stakeholders through information sharing sessions • http://www.epa.gov/climatechange/emissions/ghgrulemaking.html

  18. Advance Notice of Proposed Rulemaking (ANPR) Greenhouse Gas Emissions • One of the steps EPA has taken in response to the U.S. Supreme Court’s decision in Massachusetts v. EPA • Seeks input on a variety of topics including potential regulatory approaches and technologies for reducing GHG emissions • ANPR published in the Federal Register on July 30, 2008 (comment period closes November 28, 2008)
