  9. It has always been our intention that neighbourhood development plans should be flexible…. We want communities to be able to use neighbourhood planning in ways which reflect their needs and their vision for the future. Neighbourhood development plans can be as simple or as ambitious as the community wants to make them. They can include policies covering the whole area, or could have just one or two policies focused on a specific site, such as a high street or a valued green space.   12. THE EXAMINATION

  13. Who can examine a Neighbourhood Plan? • The authority may appoint a person to carry out the examination, but only if the qualifying body consents to the appointment. • The person appointed must be someone who, in the opinion of the person making the appointment— (a) is independent of the qualifying body and the authority, (b) does not have an interest in any land that may be affected by the draft order, and (c) has appropriate qualifications and experience. • NPIERS

  14. Purpose of the examination: • Does it meet the Basic Conditions? Examiners are specifically prevented under the Localism Act from looking at something which is not set out in the basic conditions: • It has regard to the national policies and guidance issued by the Secretary of State • It is in general conformity with the strategic policies contained in the development plan for the area • It contributes to the achievement of sustainable development • it is compatible with EU obligations

Examiners report: The report must recommend either— (a) that the draft order is submitted to a referendum, or (b) that modifications specified in the report are made to the draft order and that the draft order as modified is submitted to a referendum, or (c) that the proposal for the order is refused. The examiners to date all recommended modifications to enable the plan to comply with the basic conditions

Common issues: • General conformity with the development plan • Policy wording: • The NPPF states that ‘plans should provide a practical framework within which decisions on planning applications can be made with a high degree of predictability and efficiency.’ • Structure and formatting • Strength of the evidence base • Is the Policy reasonable?
