National Manufacturing Policy Support for technology including permanent R&D tax credit Encourage investment and create certainty Comprehensive energy strategy Trade policy that opens markets and reduces barriers Eliminate federal mandates and labor regulations that undermine flexibility or discourage hiring

Advanced Energy-Efficient, Clean Vehicles • Need to be Addressed in Comprehensive Energy Policy • Authorize research, development, deployment, and commercial application activities for more fuel efficient advanced technology components (HR 1367 and S 734) • Provide assistance to allow small manufacturers to retool facilities • Extend and increase the tax credit for the purchase of medium- and heavy-duty hybrid vehicles • Provide incentives for the installation of anti-idling technologies on diesel-powered on-highway vehicles • Improve and expand the Advanced Technology Vehicle Manufacturing Loan Program at the Department of Energy • Strengthen and make permanent the R&D tax credit

Regulatory Reform • MEMA Advocates a Balanced FrameworkNotLegislation by Regulation • REINS Act - Regulations from the Executive in Need of Scrutiny Act of 2011 • Requires congressional review of agency rulemakings to require congressional approval of major rules before they may take effect • Major rule defined as any rule that would: • Have an annual effect on the economy of $100 million or more • Cause a major increase in costs or prices • Significant adverse effects on competition, employment, investment, productivity, innovation, or U.S. competitiveness • Congress would have 70 legislative days to take action

Transportation Reauthorization • Need Transportation Bill for Manufacturing • Should Not Favor Rail/Mass Transit • Extension Possible to September 2011 • MEMA Supports – • Long-term comprehensive bill • Incentives for heavy-duty vehicle safety technology • National safety inspection program administered by States

  10. Patent Reform • Senate overwhelmingly passed comprehensive legislation (S. 23) • Seeks to address backlog at PTO by keeping fees at PTO • Creates new level of post grant review – most innovators concerned that new level of review does not provide sufficient safeguards against frivolous challenges • House bill (H.R. 1259) introduced, expected to be considered in coming weeks • Also addresses backlog at PTO • Post-grant review process weaker than Senate bill • House debate expected to be contentious

Copper Legislation and Regulations • WA and CA legislation passed • WA regulatory process most active • MEMA working with SAE to create industry positions • Immediate issues: self-certification/ testing/enforcement/exemptions • NY and AK legislation not moving • S. 945 – OR • Passed the State Senate • Held up in State House • Might return next year
