  2. Presentation of the forum • Set up following the European Parliament resolution on the social aspects of housing (May 1997), • Forum of exchange and debate between the different players in the housing sector represented in Brussels.

  3. Aims of the forum • exchange of information between its members, • identification of study themes, • implementation of joint initiatives towards european institutions • promoting the importance of the housing sector at the EU level.

  7. The right to housing in the european Charter 2000 : The Forum has invited the convention of fundamental Rights to debate the issue of having the right to housing recognised in the draft charter. Hearing of NGOs, Brussels : april 27th

Forum statement • The right to housing is now recognised in a large number of declarations, charters and constitutions of member States ; • It is therefore clearly a value shared by the member States of the European Union ; • The right to housing is defined by making reference to other universally accepted fundamental rights ;

Housing is already present... • European Parliament has pronounced several times on the recognition of the right to housing within the EU. • EuropeanCommission’s communication called “Building a Europe of social inclusion” states “that the loss of housing is one of the most serious manifestations of poverty and social exclusion in the European Union”. • The Bertal-Haarder report adopted by the European Parliament includes the conditions for adequate housing in terms of economic and social rights. • More generally, the development of integrated approaches on social exclusion, discrimination and sustainable urban development lead to a better incorporation of the issue represented by access to housing on the level of the EU.

Fact: The effects of Community policies on the housing sector are on the increase: taxation of social housing (VAT), public contracts, services of general economic interest, rules of competition, system of State aid, consumer protection in terms of mortgage loans, building sector and products, energy-efficient buildings, All those elements of Community law which increasingly challenge the instruments and players of housing policies at the risk of jeopardising their effectiveness and their missions. Proposals: seize on these issues, evaluate the effects of developments in Community law on the instruments of housing policies, promote recognition of the housing debate in the internal market by pronouncing it a service of general economic interest.   13. Fact: The EU has developed a Social Agenda, containing in particular a European inclusion strategy. National inclusion plans comprise a not inconsiderable housing section, whose aim is to provide access to decent housing for all and to fight against eviction. Proposals: Pleased with this progress and with the method adopted, consisting in reconciling compliance with Community subsidiarity and added value through the adoption of a European strategy and an evaluation process. Request the ministers to conduct among themselves and with the Community authorities a study on the subject of decent housing within the framework of an evaluation of national action plans, with a view to defining and acknowledging a body of rules which contribute to equal access to decent housing in the EU.   14. Fact: The Charter of Fundamental Rights of the European Union is limited to recognising the right to housing benefit. To date it is not subject to any compelling legal implications. This rather nuanced result is the result of a compromise and translates the diversity of national attitudes in terms of recognising and conceiving the right to housing in the EU Proposals: Request the Ministers to pursue their efforts with a view to effectively developing a right to decent housing for all in the EU, whatever its concept and legal basis, in accordance with the international commitments reaffirmed at the Habitat II + 5 conference. Invite the governments of signatory States to the revised social charter of the Council of Europe to pursue their commitments by proceeding with its ratification, and hence to promote recognition of the role played by housing in implementing Human Rights. Main conclusions • Social exclusion is a complexe and cumulative process; • Members States must provide integrated framework to reinforce social cohesion; • Housing is one of the core elements in combating social exclusion (EU stategy for social inclusion); • Access for all to a decent housing must be a shared target of EU member States in combating social exclusion; • European Commission should support cooperation and exchange of informations; • European monitoring and exchange on national policies and housing strategies to implement access to a decent housing for all.
