  2. SUSPENSION • License is taken away for a required amount of time, but is returned to you at the end of that time period.

  3. REVOCATION • License is CANCELLED • At the end of the revocation period, you may re-apply and re-test for your license, but that application may be denied.

  4. PENALTIES FOR DRIVERS UNDER 21 • ZERO TOLERANCE VIOLATION: (BAC 0.02%-0.07%) • 1ST Offense: License is suspended for 6 months • $125 fine • $100 to get license back

  5. PENALTIES FOR DRIVERS UNDER 21 • 2nd Offense: License is revoked until 21 (or 1 year) • Whichever is longer

  6. DWI CONVICTION-Driving While Intoxicated (BAC 0.08% or higher) • 1st Offense: License is revoked for 1 year • $500-$1000 fine • Up to one year in jail or more= FELONY

  7. DWI CONVICTION • 2nd Offense: License is revoked until 21 (or 1 year) • $1000-$5000 fine • Up to 4 years in jail

  8. For a driver's first alcohol-related offense, his or her license is suspended for 90 days. For the next two offenses, the driver's license is suspended for six months each time. New York does not require jail time after the second offense, whereas other states do.

  9. DUI- Driving Under the Influence • DUI usually signifies a lesser degree of intoxication, which is determined by a person’s blood alcohol level at the time of arrest. Sometimes, states will allow the charges of a DWI to be reduced to a DUI with the help of a defense attorny.

  11. IGNITION LOCKS • Installing an ignition lock in repeat offender's cars is a possibility in the state of New York. An ignition lock is a machine that is connected to a car's ignition and checks the driver's blood alcohol content level. The driver has to blow into the machine to start the car and do so from time to time while the car is running. If alcohol is detected, the car either does not start or turns itself off.
