  1. Retention Guidelines For English Language Learners (ELL) Students

  2. Retention of ELL students will not facilitate English language acquisition. •  The process of language acquisition should occur at all grade levels.

  3. We often conclude that because our ELL students are not familiar with the language, we better serve their needs through retention. • We must avoid pre-classifying our students. We should utilize assessments in the native language (whenever feasible), prior records, personal knowledge of the student, and any relevant information that can paint a clearer picture of the student’s academic knowledge.

  4. To satisfy legal requirements of Lau v. Nichols, retention of ELL students shall not be based solely upon level of English language proficiency.

  5. Prior to considering retention of an ELL student, the following points should be addressed in consultation with your ESOL Specialist, ESOL Contact Person, Instructor (s), and other members of the ELL Committee:

  6. Has the student’s level of English language proficiency been assessed? • Has the student’s level of proficiency in the native language been assessed? • Has the student been enrolled in the school district for more than one full academic year?

  7. Are classroom modifications being made in the areas of: • - teacher lesson delivery • - assignments • - homework • - formal assessments (quizzes and tests)

  8. Has an educational ELL/RTI Plan been implemented to document classroom modifications and student progress? • How much individual English language development instruction is the student receiving during the school day?

  9. Has an alternate grading strategy been implemented including a portfolio, contract or rubric assessment?

  10. Your ESOL Specialist will inquire about all of these points during ELL retention meetings.  Teachers and other instructional personnel should be prepared to address the implementation of strategies and interventions during these ELL meetings, and should provide sufficient data for support.

  11. The ELL Committee will make the final placement determination for ELL students after carefully examining all criteria for retention and considering Exemptions under Florida Statute (1008.25 (6) (b).

  12. Florida Statute (1008.25 (6) (b) • Exempts ESOL/ELL students from being retained if the students have had less than two years of services in an English for Speakers of Other Languages (ESOL) program. • Currently the state of Florida mandates retention and Good Cause Exemptions for 3rd graders who score level 1 on FCAT reading; however, it may be applied to other elementary grades.

  13. When and if you have any questions regarding the retention of ELL students, please contact your on-site ESOL Administrator, ESOL Contact, or ESOL Specialist.
