The two ways they are employing to achieve this are: delegating the responsibility of collecting tax to more online retailers, using a broader set of rules and ensuring that consumers remit the use tax part of sales tax that is due from them. Sales tax comprises two parts - the use part that is paid by the buyer and the sales parts paid by the retailer. Under the existing rules and regulations, individuals have to pay use tax in states that levy sales tax in the event that the retailer wrongly fails to collect the tax from them.

  4. Approaches to State Sales Tax Collection: With the exception of Oregon, Alaska, New Hampshire, Montana and Delaware, all the states currently impose a sales tax. Majority of these states are far more dodged in enforcing rules to widen the circle of retailers and consumers on whom sales tax is levied. At the present moment, four states including Tennessee and Michigan have laws that direct online retailers to collect and remit tax from sales and use tax pending, awaiting approval and enactment. An additional ten states have already put in place wider laws that compel online retailers to collect such tax, even in instances where such retailer does not run a store in the state but still conducts business through online links or is charged a fee as click-through nexus. These online retailers are legally compelled to collect the tax in case they have any financial or other meaningful relationship with a firm conducting its business dealings in the state concerned.

According to a tax expert, each piece of legislation signed into law raises the likelihood that if one lives in any of these states, some online retailers will be levying sales taxes when he/she inevitably buys that New York bestseller online. This legislation has already come up under close scrutiny and opposition. For example in Denver, the federal court temporarily put the enforcement of the law on hold. The laws in some jurisdictions compel retailers not collecting and remitting sales tax to send a report to the state government at the close of the year, indicating each purchaser in the state it delivered to and the value of the purchases such buyers made.
