    1. Town of Wethersfield Planning and Zoning Commission July 20, 2010 Application #1707-10-Z Town of Wethersfield Proposed Amendments To Zoning Regulations - Commercial Vehicles

Existing Regulations Commercial vehicle - any equipment or vehicle designed or used for commercial purposes or for the transport of merchandise, freight, tools, equipment or persons in the pursuit of trade and having one (1) or more of the following characteristics: It has a gross vehicle weight rating (GVWR) greater than ten-thousand (10,000) pounds. It has more than four (4) tires in contact with the ground. It bears signs, logos or markings identifying the owner or registrant, a trade, business, service or commodity, except that which identifies a unit of government.

    3. Existing Regulations (continued) No permit required in residential zones to park one (1) commercial vehicle if: Parked in a garage or in a rear yard, Vehicle is owned or used by a resident of the premises in the course of their employment, Does not exceed a gross vehicle weight rating (GVWR) of ten thousand (10,000) pounds. Require Special Permit from the PZC for: Parking of vehicles not in compliance with the regulations.

    4. Why Change Regulations? The present definition of commercial vehicles is very narrow, only 4 criteria used to define (used for business, gvwr, 4 tires, markings). The present regulations unnecessarily classify certain passenger vehicles and light trucks as commercial vehicles. Presently, some types of step vans and trucks are not considered to be commercial vehicles and are not regulated. There are no regulations for Commercially zoned property. There are no review criteria for applications. There are no submission requirements for applications. There are no limitations in the regulations for those applications regulated by the PZC. There are no exemptions to the regulations even in the Agriculture Zone for farm equipment.

    5. How Do Other Towns Regulate? Regulations Vary From Town To Town Simple Examples Newington, Bloomfield and Farmington Similar To Wethersfield Rocky Hill and Cromwell More Complicated Enfield and Windsor Proposed Regulations Follow the Enfield and Windsor Models

    14. What Are The General Changes? Create a more specific definition for commercial vehicles (9 criteria). (Revised) Create a new administrative procedure for the regulation of light/small commercial vehicles by the ZEO. (New) Transfer the authority from the PZC to the ZBA to grant approval for certain larger commercial vehicles. (Revised) Establish limitations, decision criteria and application information requirements for the ZBA. (New) Establish authority for the PZC via the Site Plan process to approve commercial vehicles in business zones. (New) Exempt certain vehicles. (New) Prohibit certain commercial vehicles. (New)

    15. What Are The Specific Changes? Revised Definition Additional Criteria (Height, Length, # Passengers, Types of Vehicles, GVWR 11,000) Require Zoning Permit For Light-Medium Duty Commercial Vehicles up to 12,000 GVWR, 8 feet in height, 25 feet long Allow Light Duty Vehicles To Park in Garages and Driveways. ZBA decision criteria, screening requirements, site plan, photos, detailed information about vehicle. PZC Site Plan required for commercially zoned property. Exemption for construction activity and farming. Vehicles such as construction equipment, wreckers, dump trucks and tractor trailers prohibited.

    16. What Are The Specific Changes? Why Increase GVWR to 11,000? (Some pick up trucks are just over 10,000 gvwr Dodge RAM 3500, Ford 350, Hummer H1) Why Limit ZEO to 12,000 GVWR? (Several medium duty trucks have 12,000 gvwr capabilities, these vehicles have more commercial vehicle characteristics)
