Humanities and Social Science Research • Some questions you need to ask? • Who ‘owns’ your data? • It’s a question linguists, anthropologists and some others need to ask • Where are you putting your data? • Your office computer? • who has a key to your office? • is your computer password-protected? • who else knows the password?

Questions to ask yourself—more • On your laptop? • is it password protected? • is it remotely wipeable?/do you have Lojack (or something like) it installed? • On a thumb drive? • did you leave it in your pocket when you sent your pants to the dry cleaner? • Are any of these devices backed up? • where?

  3. Questions to ask yourself—still more • Do you store your data in the cloud? • have you read the EULA? • what’s a EULA? • some guidance on what to look for: • http://www.educause.edu/library/resources/developing-institutional-research-data-management-plan-service • how long will your data be available? • what will happen to your data if you change your mind?

  4. Some legalistic things you must think about • Are your data sensitive? • did they require IRB approval? • do they contain ‘toxic data’? • what’s toxic? • do they contain PHI? • do they contain PII? • are they Export Controlled? • are they ‘dual use’? (encryption, heat sensing, biological agents, etc.) • do you have students/colleagues from ‘red flag’ countries?

Is your stuff FOIA-able? • Wayne State faculty are (technically) state employees (Wayne State, while constitutionally independent, belongs to the State of Michigan) • Your research, and your WSU email is officially the property of the university • You might receive a FOIA request (it has happened to WSU faculty and staff)

  6. Is your stuff FOIA-able? • If this happens, DO NOT RESPOND TO THE REQUEST!!!! • Contact the Office of General Counsel immediately. • Do not pass go, do not collect… • ‘When the dinosaurs are fighting, it’s best to remain under the table’ • John Jackson, former Chancellor of Southern Illinois University
