  8. HUD Proposed Rule Housing Counseling Program: New Certification Requirements • Can be found in Federal Register, Vol. 78 No. 178, Friday September 13, 2013. HUD Proposed Rule - Summary • Required HUD Certification of individual housing counselors. • 6 subject written test • All counselors must be certified for an agency to obtain or maintain HUD certification • Required comprehensive housing counseling programs • Deciding whether to purchase a home  Sale or disposition of a home

HUD Proposed Rule - Summary • Prohibition of funds to organizations in violation of Federal election laws. • Reimbursements of funds to HUD within 12 months for organizations found to have misused funds in material violation to statute, regulations or requirements. • Effective Date: 1 yr after the effective date of the final rule that will follow the proposed rule

  13. MHCF/AG Streamlined Grant Review Annual review of 3 year grant commitments • Purpose: • Review past year performance • Anticipate future program • Applicability • Agencies that were awarded 3 year grants

MHCF/AG Streamlined Grant Review • Description of past year’s accomplishments and use of funds • Explanation for any changes from original proposal • Review of goals and progress towards goals • Explanation for why you have not met the goals • Description of plans for next two years • Explanation of any changes from original proposal • Any additional resources needed

  15. MHCF Supplemental RFP 2 Year Grant Round (CY 14 and CY 15) • Purpose: • Increase counseling capacity across the State • Applicability • Agencies not previously awarded funds in MHCF/AG 3 year grant round

Technology Requests • DHCD will be requiring use of a mediation portal and will fund the agency fee. • Streamlined Review • Reflect fee under technology in program budget. • Supplemental Grant • Reflect fee under technology in program budget. Fee will be in addition to one time optional 10k technology request.

  26. Neighbor Works Compliance NFMC

Neighbor Works NFMC Compliance • Threshold process ensures that the Grantee and its sub-grantees, branches and/or affiliates are adhering to the terms and conditions of the NFMC Grant Agreement and Funding Announcement • Random Reviews are conducted at 25%, 60% and 95%. (File Sampling) • Please be ready with “Paper Sandwiches” by number. Don’t send documents individually.

  28. Neighbor Works NFMC Compliance • NFMC does not provide client names to Grantees but will provide Client ID numbers. (This refers to DHCD portal Numbers.) • Use Print out of Portal for Intake • TYPED information where possible • NFMC AUTHORIZATION • Errors are found, must remedy all files for that round.

  30. Special Notes About the Round 7 – Level 2 Counseling • NFMC no longer requires Close-Out Documentation • Steps Taken on Action Plan: Counselors notes alone do not satisfy the requirements. Verification that action took place is required. • Suggestions for documenting referrals to realtors- must include 3 realtors and client signature stating they received the list.

  31. Special Notes About the Round 7 • Each Grantee should send Neighbor Works America an updated audit within 6 months of its fiscal year end date. • Neighbor Works America will ask certain Grantees for updated financial statements every six months.

  32. Special Notes About the Round 7 • Exception- If a Sub-grantee has revenues less than $300,000 annually AND receives less than $25,000 in NFMC funding, the Sub-grantee may submit a Review Statement or Compilation Statement in lieu of independent audited financial statements”

  33. Special Notes About the Round 7 • Grantees must have signed the National Industry Standards Code of Ethics and Conduct and Minimum Standard Activities for Foreclosure Intervention and Default Counseling.

  34. Neighbor Works Compliance • Authorization Forms – NFMC Authorization not other Authorization Old Forms Key Provisions – remove dates!! Form must explicitly state that the client is authorizing (a). the agency to submit client-level information to the Data Collection System for the NFMC grant, (b). NFMC to open files to be reviewed for program monitoring and compliance purposes, and (c). NFMC to conduct follow-up with the client related to program evaluation.

Neighbor Works Compliance • Disclosure Language I understand that (organization name) provides information and education on numerous loan products and housing programs and I further understand that the housing counseling I receive from (organization name) in no way obligates me to choose any of theseparticular loan products or housing programs.

NFMC Level 1 Counseling Defined Level 1 Counseling - All of these completed documents must be in client file: • Intake – DHCD Portal, CMS, or HOPE LOAN PORT® • Signed Authorization with NFMC language not credit authorization or mortgage authorization • Budget • Action Plan – NFMC Compliance Worksheet • Screen for Making Home Affordable. If no, note it. If yes, application. .

  37. NFMC Level 2 Counseling Defined Level 2 Counseling - These completed documents must be in client file: • Signed Authorization with NFMC language, • Verified budget (income and debt,) • Documentation of Action Plan, • Close-out documentation. (Proof of communication with lender)

  38. Key Points to Remember • Adherence to the Industry Standards • Training for new counselors • Stay current – HUD, MHA, etc. • Reducing number of open cases. • Continue to do outstanding work • Communicate with DHCD about what is going on in your agency.
