  3. Statistics • The questionnaire was sent to 12 addressees • 9 persons from 8 countries responded.

  5. Are coercive methods being used? All countries except one report that coercive methods are being used. And the raporteur of that one country made it clear that this is not the answer of her choice. So it seems to be common human behaviour towards another human being. The difference between the countries stems from the willingness disclose this dark side of the human nature and do something about it.

Is legislation in place? • In three of the responded countries there is a very detailed and specific legislation on using restraints in non psychiatric facilities (Nw, Nl; Pt). • In one case the law provides general principles on using coersive measures (Fl). • Some countries report that they use restraints based on informed consent. (Sw, Be, EE?) In one case there is a ban on using restraints involuntarily (Sw). • Some have other non- binding instruments (like RAI questionnaire) to bring more awareness and changes into performance of the staff in this field (Fin). • The issue of using restraints in non-psychiatric facilities is not adressed in the legislation (Blg, EE).

  9. Is registration obligatory? • In six countries out of eight registration is obligatory. • If using coersive methods is not regulated or even mentioned in the context of providing care in non-psychiatric facilities in the law this obligation may be ignored.

Are the supervisory organisation involved? • Supervisory organizations are in a way or other involved in all countries. • In some countries they carry out regular control visits and participate in drafting policies to reduce using coersive methods and restraints. • In other countries they react only to complaints or find out about using restraints during visits carried out on other purposes. Their voice may be overruled.

  13. Is the use of coersive methods an issue in your country? • All the countries except two report this to be an issue. • One of these two has probably not identified using restraints as an issue yet. • May the other with the legislation in place be overly confident ?

  15. Good or bad practises? • Seven countries out of eight mention either good or bad practises. • In five occasions good practises are developed consiously and available to service providers. • In the case of two countries bad practises have surfaced in media.
