Children’s Online Privacy Protection Act • Federal Trade Commission required to issue and enforce regulations concerning children’s online privacy. • Initial COPPARule effective April 21, 2000; • Amended to provide greater protections for children under age 13 in 2011; • New rules are effective on July 1, 2013.

  3. Children’s Online Privacy Protection Act • COPPA Primary Goal: • give parents control over online information about their children; • Children under 13.

  4. Children’s Online Privacy Protection Act • COPPA Compliance: • Website or mobile apps are directed to children under 13 and: • collect, • use, or • disclose • personal information from children.

  5. Children’s Online Privacy Protection Act COPPA Personal Information: • First and last name; • A home or other physical address including street name and city; • Online contact information; • A screen or user name that functions as online contact information; • A telephone number; • A social security number; • A persistent identifier, like an IP address that can be used to recognize a user over time and across different Web sites or online services; • A photograph, video, or audio file, where such file contains a child’s image or voice; • Geolocationinformation sufficient to identify street name and city; or • Information concerning the child or the parents of that child that the operator collects online from the child and combines with an identifier described above.

Children’s Online Privacy Protection Act • The rule governs the online collection of personal information from children by a credit union, even if children volunteer the information or are not required by the operator to input the information to participate on the credit union’s web site or service.

Children’s Online Privacy Protection Act COPPA Requirements: • Online privacy policy; • Notice to parents; • Parental consenting to information collection and use; • Parental access to their child’s personal information; • Parents can prevent further use or collection of information; • Maintain the confidentiality, security, and integrity of information; and • Retain personal information collected online from a child for only as long as is needed for the purpose it was collected.

  8. Children’s Online Privacy Protection Act FTC Guidance: • If the CU website or online service is not in compliance, it must stop collecting, disclosing, or using personal information from children under age 13; and • Carefully review CU information practices and online privacy policy.

Children’s Online Privacy Protection Act FTC Resources: FTC’s Business Center - Children’s Privacy Section Materials for Mobile Apps - Marketing Your Mobile App: Get it Right From the Start.  These materials can provide you with helpful guidance in making sure you meet the COPPA requirements by July 1, 2013.
