Gun Control • Something must be done with the guns and the usage for harming people. • The guns are being used for many crimes such as bank robberies or terrorist act. • The Senate approved bills to extend background checks on gun purchases and improve school safety. • It was also considering a ban on assault weapons and an increase in federal aid for school security. • The USA government has a not so easy job trying to come up on a decision on outlawing guns.

  3. Proposed Law “No selling of automatic weapons.”

  5. 1. Court Case 1: Bryan v. United States, - U.S. - (1998) a. Conflict Convicted of aiding and abetting in stealing liquor. i. He alleged that because the principal he was charged with aiding was acquitted, he cannot be found guilty of aiding and abetting. b. Highest Court Ruling: The Court held that the term willfully in section requires proof only that the defendant knew his conduct was unlawful, not that he also knew of the federal licensing requirement. i. 6 votes for United States, 3 vote(s) against c. Precedent Set: The willfulness requirement does not carve out an exception to the traditional rule that ignorance of the law is no excuse; knowledge that the conduct is unlawful is all that is required. i.   6. 2. Court Case 2: Caron v. U.S., - U.S. - (1998) a. Conflict Caron was convicted of possessing six rifles and shotguns in violation. i. The Court of Appeals concluded that a Massachusetts law permitted Caron to posse’s rifles, but not shotguns, had restored his civil rights. b. Highest Court Ruling: 6 votes for United States, 3 vote(s) against i. The District Court found that because Massachusetts law allowed Caron to posse’s rifles, “unless” clause was not activated. The Court of Appeals reversed. c. Precedent Set: In order for a felon’s right to own firearms to be considered restored under state law, the state must give him the right to own any firearm at all, and not just some firearm, even if the specific firearm he is caught with he allowed to have under state law. i. The court in this case eviscerates two of the reforms the NRA pushed very hard to get in the 1986 FOPA.

Precedent: The willfulness requirement does not carve out an exception to the traditional rule that ignorance of the law is no excuse; knowledge that the conduct is unlawful is all that is required. b. How this supports my/our law: If you don’t know about the new law it does not excuse you from the consequences. 2. Case Two: Court Case 2: Caron v. U.S., - U.S. - (1998) a. Precedent: In order for a felon’s right to own firearms to be considered restored under state law, the state must give him the right to own any firearm at all, and not just some firearm, even if the specific firearm he is caught with he allowed to have under state law. b. How this supports my/our law: It does not really support my law.

  8. 1. Current Event Article 1: The Colorado theater shooting a. The Colorado theater shooting is one big example how guns are being used by mentally unstable people against public places. b. Twelve people are dead and 58 wounded after a heavily armed gunman entered an Aurora, Colorado, movie theater's midnight showing of "The Dark Knight Rises," letting off tear gas and firing shots into the audience. c. Due to this situation and many other security and protection has increased in many public places such as airports, theater, and schools.

  9. 2. Current Event Article 2: The Connecticut school shooting a. The Connecticut school shooting is the lattes form of violence used with weapons in a public place such as an elementary school. b. There has been a push for new gun laws in the wake of the deadly shooting in Newtown, Conn. c. Shocking the United States and leading President Barack Obama to propose new gun-control legislation.
