  2. California’s OER Legislation SB 1052 Creates the California Open Education Resources Council SB 1053 Creates the California Digital Open Source Library SB 1028 Funds SB 1052 & 1053 by transferring money from the Golden State Scholarshare Trust Fund, under some conditions.

SB 1052 Creates the California Open Education Resources Council COERC is Expected to do the following when it becomes operational Identify 50 courses – There is specific criteria stated in the bill Administer a standardized, rigorous review and approval process Promote strategies for production, access, and use of open source materials Solicit and consider student perspectives through the Statewide Student Associations Continues on next slide Textbook Legislation 2012 - OER

SB 1052 Creates the California Open Education Resources Council • COERC is Expected to do the following when it becomes operational • Produce or manage the production of 50 OER textbooks • Report to the Legislature on progress within 6 months of operation • Final Report to Legislature on January 1, 2016 • Textbooks and other materials produced pursuant to this section shall • be placed under a specific creative commons attribution license • allow easy customization, and • conform to the most current standards under various accessibility codes • House all materials in the California Open Source Digital Library (SB 1053) One more slide on SB1052 Textbook Legislation 2012 - OER

  6. SB 1052 Creates the California Open Education Resources Council Summary. SB 1052 Section 1 explains the reason for the bill Section 2 creates the COERC and defines its expectations Sections 3 & 4 amend ED Code on close captioning and other disability access formats to include any books created by this bill. Section 5 Funding: “Sections 1, 2, 3, and 4 of this act shall become operative only if funding for the purposes of this act is provided in an appropriation in the annual Budget Act or another statute, or through federal or private funds, or through a combination of state, federal, and private funds.” SB 1028 provides funding that requires an equal combination of private money and state money Textbook Legislation 2012 - OER

  7. SB 1053 Creates the California Digital Open Source Library Serves as a statewide repository for high-quality digital open source textbooks and related materials. Provides an Internet Web-based way for students, faculty, and staff to easily find, adopt, utilize, or modify course materials for little or no cost. Administered by the California State University Coordinated with the Community Colleges UC is encouraged to join Textbook Legislation 2012 - OER

  8. SB 1028 Funds SB 1052 & 1053 by appropriating money transferred from the Golden State Scholarshare Trust Fund, under some conditions. Scholarships were awarded during 2000, 2001, and 2002 Funds were put into a trust fund during those years Students who were awarded scholarships continue to collect, but many did not accept or collect the scholarships they earned. $70,000,000 in the trust fund will not be needed for scholarships and will be transferred to the General Fund in December 2012 This bill appropriates up to $5,000,000 of that unclaimed money to fund SB 1052 & SB 1053 – with conditions* * CONDITIONS Any money must be matched dollar for dollar with private money Money goes to CSU Chancellor’s Office to manage SB 1052 & 1053 CSU Chancellor reimburses CCC and UC costs NOTE: The scholarship program was discontinued after 2002. California Open Education Resources Legislation SB 1052 creates the “books” SB 1053 provides the web platforms to get the “books” to students and faculty SB 1028 may provide money to pay the costs of both bills SB 1052 depends upon SB 1028; SB 1053 depends upon SB 1052 • This bill creates a mechanism for OER • It could aid faculty in selecting OER materials • It offers a means to promote OER as a viable alternative to traditional publisher products • Creates a common OER platform across many California Colleges where none now exists • Facts & • Fancies • This bill does not guarantee students an OER textbook • Students do not choose OER book; Faculty still decide what book is best • Suggestions that printed OER books would be only $20 are hyperbole Textbook Legislation 2012 - OER
