  1. Do Now Imagine you worked for Franco’s Pizza Palace. While you were working, you invented a new pizza that turned out to be a best seller. A few years later, you opened your own place, and put the pizza on the menu. Franco’s sued, claiming you came up with idea while working for them, therefore it is theirs alone. Who do you think will win the case? Explain, using proper legal reasoning.

  2. Assignment: • Read the “You Be The Judge” Case, Mattel, Inc. v. MGA • Answer the questions & review together

  3. Conclusion • Based on the Case, Mattel, Inc. v. MGA Entertainment, Inc, choose one of the following questions: • If you were the lawyer for the Plaintiff (Mattel), would you have used a different strategy? Explain. • If you were the lawyer for the Defendant (MGA), what strategy would you have used? • If you were the judge in this case, who would you rule in favor of? Explain.

  4. So, what happened? • Initially, Mattel Inc. defeated MGA Entertainment Inc. in a conflict over the creation of the Bratz doll line. The U.S. District Court in Riverside ruled that Bratz designer CEO, Carter Bryant, violated the terms of his exclusivity contract with Mattel. It was decided that he created the Bratz doll concept while he was working for Mattel. • However, the decision was appealed.

  5. The Appeal… • In April 2011, Mattel was forced to pay $88.5 million to MGA Entertainment in a dispute over the Bratz line of dolls. In the court ruling, the judges found that Mattel did not own drawings of Bratz dolls. The Bratz dolls hurt the sales of Barbie dolls significantly over the period of time that the Bratz dolls were on the market
