Risks of legislative non-compliance • University prosecuted under OHSW Act and fined $37,500. • Penalties for breach of duty of care • Depends on ‘culpability’ and risk/degree of harm • Corporate liability ($3m max*) • Personal liability for officers ($600k/5 years gaol*) • Loss of status as self insurer for workers compensation and rehabilitation. *Proposed by Safe Work Australia under model OHS Act for ‘Category 1’ breaches.

Legislative compliance • Legislative Compliance System under corporate governance • Acts applying to the university are divided into three tiers with Tier 1 the highest risk • 51 Tier 1 or Tier 2 Acts apply to UniSA • 5 of the 9 Tier 1 Acts are directly safety related: • OHSW Act • Dangerous Substances Act • Radiation Protection and Control Act • Civil Aviation Act • Workers Rehabilitation and Compensation Act

UniSA approach • Independent position created in Audit and Risk Management team • OHSW internal audits are integrated into annual Internal Audit Schedule • Reports go directly to senior levels: Senior Management Group and Audit and Risk Management Committee • Partnership with OHSW unit in Human Resources • ‘Inspections’ are part of ongoing system monitoring in university schools, research institutes and business units
