Objectives: The objectives can be fulfilled: Individual, by each producer Transfering the responsability to an organization authorised by National Environmental Protection Agency (until now, no application received) MINISTRY OF ENVIRONMENT AND SUSTAINABLE DEVELOPMENT NATIONAL ENVIRONMENTAL PROTECTION AGENCY REGIONAL ENVIRONMENTAL PROTECTION AGENCY BACĂU

  7. Obligations Producers and importers (for new or second hand cars): Designing phase: - prevent waste generation; - restrict the use of hazardous substances; - consider the possibilities of dismantling, re-using and recovery of materials and components. Production phase: - promote the use of recycled materials - exclude the materials containing Pb, Hg, Cd, hexavalent Cr. Romania-current situation In order to fulfil the requirements of the EU Directive 2000/53/EC by the required deadlines, several actions (institutional and operational) were realised: • in 2004, former MEWM (MMDD), prepared an implementation plan for this Directive, establishing objectives and measures. • since 2004, several legislative acts were approved. • preparations activities for the first report to European Commission regarding the meeting of targets. Romania-current situation • According to the implementation plan, in 2003 there were: - 1.8 mil vehicles produced by Dacia (400,000 over 20 years old) - 100,000 vehicles produced by Daewoo (max 8 years old) - 100,000 vehicles produced by ARO (over 20 years old) for 1990-2003: -120,000 new vehicles imported - 844,000 second-hand vehicles imported (mainly OPEL and Volkswagen) In 2007: around 40 brands were on the Romanian market. Environmental Fund • Public fund created onthe bases of the European principles "polluter pays" and "producer's responsibility“ to support the most important projects on environmental protection. • its incomes are from contributions collected for industrial activities with impact on the environment and from pollution tax, paid at the first registration of a vehicle. Finances the collection and treatment of ELVs introduced on the Romanian market by individual producers or producers who doesn’t exist anymore, ifthe value of spare parts and of the recyclable materials doesn’t cover the cost. Since 2005 - Programmes for Renewal of National Car Fleet: EFA  grantof 3000 RON for a vehicle older than 12 years, registered in Romania MINISTRY OF ENVIRONMENT AND SUSTAINABLE DEVELOPMENT NATIONAL ENVIRONMENTAL PROTECTION AGENCY REGIONAL ENVIRONMENTAL PROTECTION AGENCY BACĂU

  22. How to get in the program ? The applicants (only citizens) must: • get an Acceptance Note from an agreed dealer; • get the Certificate of Destruction for the ELV sent to an authorised collector/dismantler, based on Acceptance Note; • de-register the old vehicle; • buy a new vehicle.   23. Reporting obligation (Ministerial Order 625/2007) Starting with 2007. For 2006, voluntary reporting. Methods: • Weighing, calculation based on subtraction method: mass of reused materials =mass of vehicle – (mass of liquids from depollution + mass of componentssent to recycling or recovery + mass of materials sent to landfill). • Estimation of metal content,which is considered 75% of medium mass of an empty ELV and: • reuse of non-metal components – 3% • recycle of liquids – 0.7% • recovery of liquids – 1% • recycle of tires – 1.2% • recovery of tires – 2.4% • recycle of glass – 1.4% MINISTRY OF ENVIRONMENT AND SUSTAINABLE DEVELOPMENT NATIONAL ENVIRONMENTAL PROTECTION AGENCY REGIONAL ENVIRONMENTAL PROTECTION AGENCY BACĂU

  24. Main problems • difficulties in setting up of individual or collective systems for the collection of ELV, evenly distributed in the territory; • the compliance with the restrictions in the use of heavy metals; • meeting the targets; • lack of treatment units; • difficulties in the development of technologies for the recycling/recovery of plastics and fluids from ELVs; • due to the fact that most of ELVs in Romania are 25-30 year old, the reuse of the spear parts is not a real option; • 5% of car fleet are orphan vehicles (source RAR); • imported vehicles: 7 second-hand vehicles to 1 new vehicle; • inexistence of an organization for taking over the responsibility regarding the fulfillment of the annual targets.
