  5. 2013 C&MS 101.03 Definitions • Claims. Disputes that are not settled through Steps 1 and 2 of the Dispute Resolution and Administrative Claim Process and for which the Contractor has documented costs or time incurred as a result of such disputes. The Dispute becomes a Claim when the Contractor submits a Notice of Intent to File a Claim. • Disputes. Disagreements, matters in question and differences of opinion between the Department’s personnel and the Contractor that may include a request for additional money and/or time.

  10. 2013 C&MS 105.19 Value Engineering Change Proposals The submission of the value engineering change proposal shall conform with the current guidelines on Value Engineering Change Proposals adopted by the Director Supplement 1113.

  11. 2013 C&MS 106.07 Unacceptable Materials. Unacceptable materials are all materials not conforming to the requirements of these Specifications at the time they are used. Immediately remove all unacceptable materials from the project site unless otherwise instructed by the DCE. The DCE will determine if un-acceptance materials may remain conforming to Supplement 1102

  13. 2013 C&MS 108.02 Partnering • Formerly 104.05 (SS 800 to 2010 C&MS) • C&MS 108.02 is Self-facilitated Partnering • It is the intent of the Department to partner every project. • The Project personnel is responsible for conducting the Partnering process. • Costs are incidental to the Contract. • Includes Dispute Resolution Process (108.02.G) • See Proposal Note 111 for Facilitated Partnering.

Proposal Note 111: Facilitated Partnering • Note should be considered for projects with: • Project value (> $5 Million) • Project duration (multi-year) • Project complexity • e.g. Urban High Profile • Number and Diversity of the stakeholders • Utility and Railroad involvement • Public involvement

  15. Proposal Note 111: Facilitated Partnering • Replaces the Self-facilitated Partnering requirements in… • 108.02 B. Initial Partnering Session • 108.02 E. Partner Monitoring • Compensation • Facilitator submits actual invoices to Contractor. • Contractor pays Facilitator’s submission after review with the Department. • Department reimburses Contractor for Facilitator expenses.

Proposal Note 111: Facilitated Partnering • Compensation • Initial Partnering Session: $3500 maximum. • Partnering Update Sessions (quarterly): $1500 maximum. • Maximum session rates above shall be considered full compensation for: • Venue cost • On-site time • Travel expenses • Transportation • Lodging • Incidentals

Proposal Note 111: Facilitated Partnering • Basis of Payment • Item: Special Unit: Lump Sum • Fixed amount shown in the Proposal is included in the Total Bid Amount. • Fixed amount is 50% of the Department’s estimate for total cost of all Partnering Update Sessions and Facilitator expenses. • If costs exceed the fixed amount, the Department will continue to pay its share via change order. • The Department will not pay a percent mark-up. • Partial Payments according to C&MS 109.09. • Item exempt from non-performance table in C&MS 104.02.

Extension to the Completion Date for Weather or Seasonal Conditions. • Delays caused by weather and seasonal conditions should be anticipated and will be considered as the basis for an extension of time when the Contractor’s accepted progress schedule depicts Work on the critical path and the actual workdays lost exceeds the number of work days lost each month as determined by Table 108.06-1.

SS800 04/19/13106.09 Steel and Iron Products Made in the United States • MAP-21 amended Buy America • Amended the Code of Federal Regulations to apply Buy America to any project that has federal funding in any prior phase; i.e. environmental studies, right of way acquisition, preliminary engineering or other phase defined in the environmental document. • Proposal Note 117 will be included by the designer for projects meeting this provision.

  26. SS800 04/19/13106.09 Steel and Iron Products Made in the United States • FHWA Memo dated December 21, 2012 clarified Buy America • Buy America does not apply to manufactured products that have steel or iron content less than 90% when delivered to the project

SS800 04/19/13106.09 Steel and Iron Products Made in the United States • FHWA Memo dated December 21, 2012 clarified Buy America • Buy America does not apply to incidental subcomponents or hardware used to assemble manufactured products. • Examples include, but are not limited to, cabinets, covers, shelves, clamps, fittings, sleeves, washers, bolts, nuts, screws, tie wire, spacers, chairs, lifting hooks, faucets, door hinges, etc. • C&MS 106.09 has been revised to include this language
