  6. Does your Client understand what he is asking for? • Control Client expectations. Don’t oversell the benefits particularly on first BIM projects. • Appointments should detail the scope and objectives of the BIM. • Include a Schedule of BIM Deliverables (programme). (Ensure that you allow for a time overhead on the set up of a first BIM project (particularly 5D).) • Agree where the BIM database is to be located and the security responsibilities thereof. • Appointment Documentation should refer to the drawing up of BIM protocols between contributing parties (this too should be programmed) . © SmartBIM Solutions 2011 SMARTBIM Solutions Appointment Contracts

  9. AIA Document 202 - 2008 • Your appointment should state the level of detail of the BIM at each work stage. • Note when a record copy of the BIM is required. At each defined work stage as a minimum. (AON recommend weekly copies.) LOD 100 • Define the permissible uses of the BIM at each work stage. When is the BIM itself a construction document? LOD 200 • Define the identity and role of the Information (Model) Manager on collaborative BIM projects. LOD 300 • Charge for all services outside standard scope of works for an architect. LOD 400 • Get your legal advisors and insurers (Brokers) to review and comment upon the appointment before you sign. LOD 500 © SmartBIM Solutions 2011 SMARTBIM Solutions Appointment Contracts

  10. ` Melbourne Convention & Exhibition Centre, Australia A Plenary Group Public Private Partnership Architects: Woods Bagot and NH Archi`tecture • Where sub-contractors are contributing to the BIM a detailed CDP Matrix becomes vital. • Clear definition of construction modelers roles and responsibilities. • If the architect is construction modeling for the contractor, unambiguous agreement of responsibility for these portions of the work must be documented. SMARTBIM Solutions Appointment by the Contractor

  11. Define at the outset what rights your client has to use project information. • Joint rights? • Grant of non exclusive rights to all users for the purpose of the project only? • Use by owners for facilities management? • Use of Data rather than the model itself? © SmartBIM Solutions 2011 SMARTBIM Solutions Intellectual Property Rights

  12. Detail permissible uses of the model. No party to have liability resulting from use of Model beyond uses set out. • If you provide for the re-usage of the BIM ensure that appointment documents allow only for re-usage in exactly the same way / relationship as in the original design. • If IPR rights are not confined to single usage ensure that you are paid more. Your insurers will charge you more! © SmartBIM Solutions 2011 SMARTBIM Solutions Intellectual Property Rights
