Notice of Intent to Construct • Establishes base date for setback compliance determination • (“who was here first”) • Required for construction of any livestock facility or livestock waste handling facility • Must be submitted and approved prior to construction • May trigger Public Informational Meeting process (lagoon or “new” >1,000a.u.)

  4. Notice of Intent to Construct Common Issues: • Ensure that all blanks are complete • List all existing and proposed structures • Distinguish • Map should depict compliance with applicable setback • Submit a complete plot plan • Sign application

  5. Notice of Intent to Construct “New” Facility vs. “Expansion” Facility

Definitions • “New” facility • No existing structures; or • Expansion where fixed capital cost of the new components constructed within a 2-year period exceed 50% of the cost of a comparable entirely new facility • New Facilities subject to numeric setbacks • ¼ mile residential setback • ½ mile populated area setback

Notice of Intent to Construct • “Expansion” Facility • Expanded, not “ new” if fixed capital cost of the new components constructed within a 2-year period does not exceed 50% of the cost of a comparable entirely new facility • Expansions are subject to maximum feasible location • Proposed structure must be closer to owner’s residence or existing livestock structures than nearest non-facility owned residence.

  9. $500,000 + $250,000 = $750,000 Existing Replacement Cost New Construction Cost Total $ 250,000 750,000 X 100 = 33.3% New building must be less than 50% of total to qualify as “Expansion”

Construction Standards • Lagoons • ASAE 403.2 or NRCS “Waste Treatment Lagoon” • Site investigation (50 feet below planned bottom - results to adjust design requirements) • Non-Lagoons • MWPS-36, MWPS-18, NRCS standards • Site investigation (karst area, 100 yr. Flood plain, aquifer material w/in 5 ft of bottom – results to adjust design requirementsor prohibit construction)

  22. Perimeter Foundation Drain • Required when seasonal high water table may encroach upon the bottom of the waste handling structure • Quarterly monitoring requirement • Supporting justification must be provided if not installed • Soil boring • Soil survey
