  9. New Region 7 LEP - Amputations • Effective April 26, 2013 • NAICS codes with known high rates of amputations targeted (40 industry codes) • CSHO will be looking for certain types of equipment and evidence of past amputation incidents on OSHA logs

  10. National Temporary Worker Initiative • Effective April 2013 • High incidence of temp worker fatalities during first few days on the job • Example: 21yo temp worker killed on first day of work – Bacardi Bottling Co. • CSHOs to look closely at the management of temp workers, especially S&H training, during programmed and unprogrammed inspections

  13. FY 2012 Kansas City Inspection Data • Number of Inspections: 701 • 56% in Construction • $/Serious: $2809 • Serious, Willful, Repeat: 93.5% • Contest Rate: 2.8% • In Compliance: 36%

  14. Major revisions to the Hazard Communication Standard • Hazard classification: Provides specific criteria for classification of health and physical hazards, as well as classification of mixtures. • Labels: Chemical manufacturers and importers will be required to provide a label that includes a harmonized signal word, pictogram, and hazard statement for each hazard class and category. Precautionary statements must also be provided. • Safety Data Sheets: Will now have a specified 16-section format. • Information and training: The Revised HCS requires that workers be trained within two years to facilitate recognition and understanding of the new labels and safety data sheets.

  17. Safety Data Sheets • Safety Data Sheets • Sections 1 -11 and section 16 would be mandatory • Sections 12 -15 would be non-mandatory since they are outside OSHA’s jurisdiction • A new Appendix D, Safety Data Sheets, provides the details of what is to be included in each section

Incentive Program Guidance • Refer to March 12, 2012, memo by Richard Fairfax titled “Employer Safety Incentive and Disincentive Policies and Practices.” • Incentive programs that create a potential for an employee to not report an injury may be prosecuted under Section 11(c) of OSHA Act and/or other Whistleblower Statutes
