  1. NISD Student Code of Conduct • Category I - Offense for which a student SHALL BE expelled. • Category II - Offense for which a student MAY BE expelled or SHALL BE placed in a DAEP. • Category III - Offense for which a student SHALL BE placed in a DAEP. • Category IV - Offense for which a student MAY BE placed in a DAEP or suspended.

  2. Category I Offenses: Mandatory Expulsion • Firearm • Illegal Knife, Club, or Prohibited Weapon • Texas Penal Code Title V Felony (offenses against a person) • Felony Drug or Alcohol • Arson

  3. Category II – Discretionary Expulsion/Mandatory DAEP • Persistent Misbehavior while @ DAEP • Felony Criminal Mischief • Assault w/Bodily Injury against Staff • False Alarm • Terroristic Threat • Misdemeanor Drug/Alcohol • Felony Weapon/Title V Felony within 300 feet of school property.

  4. Category III – Mandatory DAEP • Assault w/ Bodily Injury to student • Public Lewdness/Indecent Exposure • Deferred prosecution, jury finding, or reasonable belief that a Title V Felony has been committed regardless of location.

  5. Category IV – Discretionary DAEP and/or Suspension • Persistent Misbehavior • Serious Fight • Profanity directed at staff • Extreme, Flagrant Insubordination • Theft • Criminal Mischief • AUP Violation • Disruption to the school environment • Reasonable belief that a Non-Title V Offense has been committed regardless of location
