  2. “Beyond a Reasonable Doubt” “Clear & Convincing Evidence” “Preponderance of the Evidence” “Substantial Evidence” “Mere Scintilla of Evidence” Different Standards of Proof

  3. Section VII(c ) of the CRB Policies & Procedures states: “ Findings “At the conclusion of each review or investigation, the CRB shall render one of the following findings based on the preponderance of the evidence:”

  4. The trier of fact must believe that it is more probable that the fact is true or exists than it is that it does not exist. “Preponderance of the Evidence”

  5. “Beyond a Reasonable Doubt”— “a reasonable doubt is based upon reason and common sense….must be proof of such a convincing character that you would be willing to rely and act upon it unhesitatingly…convinced to a moral certainty” Same evidence could satisfy “Preponderance of the Evidence” standard and not the “Beyond a Reasonable Doubt” standard.
