She then decided to change her name to Lina Joy. • She wants to marry her Christian boyfriend, a cook, but she cannot do so while her identity card declares her to be Muslim. Lina Joy事件反思(30/5/2007) • In 1999, the National Registration Department allowed her to change the name in her identity card to Lina Joy but refused to remove the word “Islam” from her card. • The National Registration Department insisted that it could not do so without a Shariah Court order certifying she had renounced Islam. • Joy then took the matter to the civil court, citing Article 11 of the constitution. Lina Joy事件反思(30/5/2007) • On 30 May 2007 (Wednesday): The Federal Court decided 2 to 1 against her.Chief Justice Ahmad Fairuz Sheikh Abdul Halim said: “Apostasy is within the jurisdiction of the Islamic law and the Shariah court. The civil court cannot interfere.” • The dissenting opinion came from a Christian judge, Richard Malanjum, who termed it unreasonable to force Joy to go to the Shariah Court, knowing that apostasy is a criminal offence under the Shariah law and she would be punished.
