  1. Breaking Ground with Design-Build: Developing MSD’s Design-Build Strategy Jared Barr, P.E. – Metropolitan St. Louis Sewer District Cary Duchene, P.E. – Black & Veatch

  2. Agenda • MSD Project Delivery History • What is Design-Build at MSD • Development of MSD’s Design Build Selection Procedures • What is the Future Role of Design-Build at MSD

  3. History

  4. Metropolitan St. Louis Sewer District • Formed in 1954 as a Political Subdivision of Missouri • Began Operations in 1956 • Since 1956, using Design-Bid-Build MSD has • Constructed 7 WWTPs • Constructed/Rehabilitated thousands of miles of sewer • Constructed/Maintained Pump Stations, Sanitary Storage Tanks, and Tunnels

  5. Beginning of Design-Build at MSD • Received Legislative Authority to enter Design-Build Contracts in 2011 (MoRS 249.0425) • Amended MSD Charter to include Design-Build in 2012 • Identified Mississippi Floodwall ORS Pump Stations Rehabilitation as First Design-Build Project for FY2017 • Hired Black & Veatch to assist in developing Design-Build procedures and procure a Design-Builder for the Mississippi Floodwall ORS Pump Stations Rehabilitation project

  6. Design-Build at MSD

  7. What is Design-Build? • MoRS 249.425.1.(1)…"Design-build", a project for which the design and construction services are furnished under one contract

  8. Traditional Project Delivery

  9. Collaborative Delivery:Fixed Price Design-Build

  10. Design-Build and Process Defined in Legislation • What is design-build? • Which projects are eligible? • How are projects advertised. • How many proposals may be solicited and received? • Qualifications and bonding requirements for design-builder • How are proposals to be submitted? • How are proposals to be evaluated? • Who may develop the request for proposals on the Owner’s behalf? MSD’s Design-Build law, MoRS 249.425, defines design-build and its process. Topics covered include:

Design-Build and Process Defined in Legislation • What is design-build? • Which projects are eligible? • How are projects advertised. • How many proposals may be solicited and received? • Qualifications and bonding requirements for design-builder • How are proposals to be submitted? • How are proposals to be evaluated? • Who may develop the request for proposals on the Owner’s behalf? MSD’s Design-Build law, MoRS 249.425, defines design-build and its process. Topics covered include:

  12. Which projects are eligible? • MoRS 249.425.1.(4)…"Design-build project", the design,…the construction, replacement or rehabilitation of a sewer district pump station or any other project that is located solely on sewer district property, such that in all cases, the project must exceed an expenditure of one million dollars.

  13. How many proposals may be solicited and received? • MoRS 249.425.2.(4)…The sewer district is authorized to issue a request for proposals to a maximum of five design-build contractors who are prequalified… • MoRS 249.425.3.(2)… If the sewer district fails to receive at least two responsive submissions from prequalified design-build contractors, submissions shall not be opened and the sewer shall readvertise the project.

  14. How are proposals to be submitted? • MoRS 249.425.3.(4)… The proposals from prequalified design-build contractors shall be submitted sealed and in writing, to be opened publicly at the time and place of the sewer district's choosing. Technical proposals and qualifications submissions shall be submitted separately from any cost proposals..

  15. How are proposals to be evaluated? • MoRS 249.425.3.(4)… No cost proposal shall be opened until the technical proposals and qualifications submissions are first opened, evaluated, and ranked in accordance with the criteria identified by the sewer district in the request for proposals • MoRS 249.425.3.(5)… The design-build contract shall be awarded to the design-build contractor whose proposal represents the best overall value to the sewer district in terms of quality, technical skill, schedule, and cost.

  16. Who may develop the request for proposals on behalf of the Owner? • MoRS 249.425.5.(1)… A sewer district planning a design-build project shall retain an architect or engineer…[for] preparation of the request for proposals... The sewer district shall also retain that same architect or engineer or another to perform contract administration functions…

  17. Developing Design-Build Selection Procedures

  18. What was Required? • Educating Staff and Board of Trustees • Developing Two Step (RFQ/RFP) Selection Process • Define Selection Criteria • Define Selection Committee • Define weighting between Technical Proposal and cost • Develop Contract Documents • Develop Diversity Policy

  19. Black & Veatch’s Role • Listen to MSD Staff • Refresh knowledge and educate • Assist identifying and developing project drivers • Develop RFQ/RFP process • Satisfy State Law • Compatible with existing MSD processes • Recommend and Develop Contract Documents • Familiar General Conditions • Workflows compatible with other construction processes • Revise terminology in existing Diversity Policies to be consistent and applicable to Design-Build

  20. The Future of Design-Build at MSD

  21. How will MSD use Design-Build? • Still defining most appropriate projects. Some project types may include: • Projects with long lead time components • Rehabilitation within existing facilities • New or alternative technologies • Schedule critical or construction means and method dependent

  22. What does MSD hope to gain? • Flexibility in Project Delivery • Innovation • Collaboration • Take full advantage of the changing construction industry

  23. Current and Planned Future MSD Design-Build Projects • Mississippi Floodwall ORS Pump Stations Rehabilitation • Phase 1 underway with Alberici Constructors • Phase 2 RFQ Fall 2019 • Additional Phases • Kingsland Sanitary Storage Facility • Procurement in process • Bissell and Lemay Fluidized Bed Incinerators
