CONSTITUIÇÃO FEDERAL Art. 6º - São direitos sociais a educação, a saúde, a alimentação, o trabalho, a moradia, o lazer, a segurança, a previdência social, a proteção à maternidade e à infância, a assistência aos desamparados, na forma desta Constituição. (Redação dada pela Emenda Constitucional nº 64, de 2010)

LDB 9394/96 Art. 7º O ensino é livre à iniciativa privada, atendidas as seguintes condições: I - cumprimento das normas gerais da educação nacional e do respectivo sistema de ensino; II - autorização de funcionamento e avaliação de qualidade pelo Poder Público; III - capacidade de autofinanciamento, ressalvado o previsto no art. 213 da Constituição Federal.

ESCOLAS PRIVADAS • Lucrativas (tratamento capitalista) • Não – lucrativas (reconhecimento oficial e recursos públicos) • Comunitárias – formas artesanais de produção, via ensino • Confessionais – prática não lucrativa inerente à fraternidade • Filantrópicas – favorece os indivíduos carentes ao estatuto pleno da cidadania
