  2. State mandated position Certification position (D.O.E) Enforces Federal, State, and Local school related laws The only legal petitioner on CHINS and other attendance cases. Performs district wide duties >>>>> Respond to calls from schools Respond to calls from community: (Parents, Library, merchants, DCF, Courts, Police) Am phone check in Home visits (unannounced) Residence confirmation checks Apprehend kids in public places (safety enclosure in car) File and process all the districts CHINS File attendance charges Attendance groups at school Presentations Dr. Visits Brief Position Description

(MGL Chapter 76 Sec. 19) Employment of Supervisor of Attendance (MGL Chapter 76 Sec.2) Duties of Parents Penalty ($20) (MGL Chapter 76 Sec.4) Inducing Absence Penalty ($200) (MGL Chapter 76 Sec.20) Power to apprehend truants w/o a warrant (MGL Chapter 76 section 1A) Parents must provide notification and contact information (MGL Chapter 72 Sec.2) Registration of Children (whoever withholds info or makes false statements ($50fine) CHINS Statute Some Attendance Laws

CHINS • Child in Need of Services • Four Types (Truant, Habitual, Runaway, Stubborn) • Age restrictions • Recent change to school Truant CHINS (8 absences per quarter) • Process: • Diversion (informal) • Preliminary (attorney’s assigned Ct Clinic, DFC referral G.A.L) • Hearing on the merits (trial) • Trial (Petitioner is cross examined and can call and examine witnesses) • Adjudication is in 6 month increments. • Disposition (Intervention, conditions) • Out of home placement (ultimate outcome)

  5. Plymouth Statistics • 268 CHINS between Sept.1999 - Oct. 2009 • 190 Truant, 78 Habitual School Offender • 180 From north districts vs. 60 from south districts (elementary not included) • 240 Secondary vs. 28 from elementary schools • 6 Failure to Cause (5 from elementary schools)
