Overview • In the list of Union legislation published before 1st January 2011 the acquis on food labelling is listed in Chapter 1 of Title 4 – Food Safety Rules • The acquis is listed as Basic Text(s) and Application Text(s) • This presentation will start with the legal framework in Iceland and secondly focus on the implementation of the relevant EU legislation

Legal framework • The legislation on labelling is EEA relevant • Most of the legislation has been implemented in Iceland • The legislation is implemented according to the provisions of the Icelandic Food Act No 93/1995 • There is some backlog of EU legislation relevant to the EEA Agreement waiting to be incorporated into the Agreement or waiting to be implemented in Iceland

  4. Basic texts – Regulation (IS) No 503/2005 • Implements Directive 2000/13/EC on labelling, presentation and advertising of foodstuffs, with amendments* • Directive 87/250/EEC, alcoholic strength • Directive 89/396/EEC, identification of lots * Some amendments have not yet been incorporated into the EEA Agreement (e.g. Regulations (EC) No 1332 and 1334/2008)

  5. Basic texts – Regulation (IS) No 410/2009 • Implements Directive 90/496/EEC on nutrition labelling for foodstuffs, with amendments • This legislation is fully implemented in Iceland

  6. Basic texts – Regulation (IS) No 406/2010 • Implements Regulation (EC) No 1924/2006 on nutrition and health claims, with amendment No 109/2008. • Amendment by Regulation (EC) No 116/2010 has not yet been incorporated into the EEA Agreement • This should cover the Basic texts on labelling under Chapter 1, Title 4 on Food Safety Rules

  7. Application texts – Regulations (IS) No 884/2003 and 681/2005 • The first Regulation implements Directive 2002/67/EC on quinine and caffeine • The second Regulation implements Regulation (EC) No 608/2004 on phytosterols etc. • There are several application texts (Regulations) waiting for incorporation into the EEA Agreement on authorisation or refusal concerning health claims

  8. Conclusions • The EEA relevant legislation already incorporated into the EEA Agreement has been implemented in Iceland • Some EC Regulations have not been incorporated into the EEA Agreement • Most of the outstanding legislation concerns the authorisation of health claims
