  2. Property-CarryingFour Rules • 11 Hour Rule A Driver Shall not DRIVE more than 11 hours following the equivalent of at least 10 consecutive hours off duty. • 14 Hour Rule A Driver Shall not DRIVE after coming on duty 14 hours following the equivalent of at least 10 consecutive hours off duty.

  3. 60 Hour Rule A Driver Shall not DRIVE after being on duty 60 hours in any 7 conseutive days. • 70 hour Rule A Driver Shall not DRIVE after being on duty 70 hours in any 8 consecutive days.

  4. Rest Period Options • Off Duty Time At least 10 consecutive and uninterrupted hours off duty. • Continuous Sleeper Berth Provision At least 10 consecutive and uninterrupted hours in the sleeper berth.

  5. Continuous Off Duty and Sleeper Berth Provision : At least 10 consecutive hours sleeper berth and off duty time combined and uninterrupted. • Sleeper Berth : The equivalent of at least 10 consecutive hours off duty.

  6. Required Information In A LOG BOOK • Date • Total miles driving today • Truck or Tractor and Trailer number • Name of Carrier • Drivers signature/ certification • 24-hour period starting time • Main office address

  7. Remarks- locations where change of duty status occurs. • Name of co-driver if applicable. • Total hours ( at far right edge of grid) • Shipping document number (s) or name of shipper and commodity.

  8. Hand Held On Board Recording Devices ( AOBRDs) • A electronic or mechanical device capable of recording drivers duty status information accurately and automatically as required by CFR 395.15. • The device must be integrally synchronized with specific operations of the commercial motor vehicle in which it is installed.

  9. AOBRD Definition cont. • “At a minimum , the device must record engine use , road speed , miles driven , the date and time of day”

  10. AOBRDs must be capable of producing: • Hours of service Chart • Electronic Display • Or Printout showing time and sequence of duty status change • Note : Being able to print is not a violation CFR395.15 does not require AOBRDs to produce a print out at roadside.

  11. On Board Information • Must have an instruction sheet: • How data may be stored • How data may be retrieved from the recording system • Must have a supply of blank driver’s record of duty status graph -grids

  12. A smart phone log book application does not constitute an AOBRD, as it is not communicating with the vehicle by being integrally synchronized.

  13. Use of Mobile Telephone • Using at least one hand to hold a mobile telephone to conduct a voice communication; • Dialing or answering a mobile telephone by pressing more than a single button • Reaching for a mobile telephone in a manner that requires a driver to maneuver so that he or she is no longer seated driving position, restrained by a seat belt that is properly installed.

  14. Use of Hand-Held Mobile Telephone • No driver shall use a hand-held mobile telephone while driving • No motor carrier shall allow or require its drivers to use a hand-held mobile telephone while driving

  15. Definition • Driving means operating a commercial motor vehicle on a highway , including while temporarily stationary because of traffic , a traffic control device , or other momentary delays • Driving does not include operating a commercial motor vehicle when the driver has moved the vehicle to the side of or off a highway and has halted in a location where the vehicle can safely remain stationary.

  16. Exceptions • 911 calls to report a accident • A bluetooth wireless or wired device • A speaker phone function • Use of single-button control on the steering wheel or dash board • Push to talk two way communications
