  1. PRESENTATION TO THE PORTFOLIO COMMITTEE ON HUMAN SETTLEMENTS 5 SEPTEMBER 2012 DRAFT HOUSING DEVELOPMENT AGENCY REGULATIONS DEVELOPED UNDER THE HOUSING DEVELOPMENT AGENCY ACT, 2008

Background • The Housing Development Agency Act, 2008 commenced on the 30th September 2008. • The objects of the Act is to establish the Housing Development Agency; to provide for its functions and powers; and to provide for matters connected therewith. • The Primary function of the HDA is to identify, acquire, hold, develop and release state, privately and communal owned land for residential and community development.

  3. Background (continue) • Section 32 of the Housing Development Agency Act provides as follows:

(1) The Minister must, after consultation with the Agency and Parliament make • regulations regarding— • (a) meetings to be held by the Board; • (b) regularity of meetings; • (c) special meetings; • (d) the taking of decisions at meetings; • (e) convening of meetings and notices of meetings; • (f) meetings by telephone or video conference or other means of communication;

(g) Quorum at meetings; • (h) Adjournment of meetings; • The person presiding at the meetings; • (j) Minutes; • (k) Resolutions signed by members of the Board; • (l) Execution of documents; and • (m) the proceedings of the Board. • (2) The Minister may, after consultation with the Agency and Parliament, make regulations regarding— • (a) any matter that this Act requires or permits to be prescribed; and • (b) generally, any ancillary or incidental, administrative or procedural matter that

  6. Consultation process • The Department finalised the draft Regulations in consultation with the Agency as required in terms of section 32(1) of the Act. • The Draft regulations were published in the Government Gazette (No. 34651) for comments • Two (2) comments were received.

  7. Consultation process (Continue) • As part of the consultation process, the Department is required to also consult with Parliament before the Regulations are promulgated.

  8. Contents of the Regulations • Regulation 1 : Definitions; • Regulation 2: Meetings of the Board; • Regulation 3: Notices of meetings; • Regulation 4: Quorum; • Regulation 5: Adjournment;
