Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) 1972

1. The passing of this law allowed the EPA (Environmental Protection Agency) to regulate various amounts of pesticides used and sold Many amendments have been issued for FIFRA including the Food Quality Protection Act (FQPA) FIFRA does not override state and local law, therefore leaving the local government control over its own domestic product On October 25, 1988, Ronald Regan amended FIFRA in order enforce the EPA’s strength on pesticides Federal Insecticide, Fungicide and Rodenticide Act (FIFRA)1972 FROM the EPA

2. FIFRA continues • Tolerance: only so much residue of the pesticide may be on the food or feed according to EPA guidelines • When importing goods, FIFRA also applies to the imports to which the EPA regulates whether the Secretary of the Treasury can accept the import • The EPA has the right to test and band any new pesticide if it fail to meet specific requirements under Section 3 • EPA’s goal is to review all regulated pesticides every 15 years in order to keep the pesticides safe and current

3. Food Quality Protection Act (FQPA)1996 From the EPA • This law amended FIFRA and the Federal Food Drug, and Cosmetic Act (FFDCA) to change the regulations of pesticides • It gave the EPA stricter safety guidelines for the tolerance of pesticides • Sets a health based standard

4. FQPA and Children • Reminds the EPA to consider children, who are more sensitive to pesticide • Includes special regulations just for children • Unlike most bills, it is very tight: • first limiting acceptable levels in any year • second giving the EPA to remove tolerable pesticides after a phase-out period • third inhibiting rights to override tolerance for children
