INSPECTOR GENERAL SEMINAR MISSION STATEMENT Made up exclusively of men and women disabled in our nation’s defense, the Disabled American Veterans is dedicated to one, single purpose — building better lives for all of our nation’s disabled veterans and their families. This mission is carried forward by:
INSPECTOR GENERAL SEMINAR • Providing free, professional assistance to veterans and their families in obtaining benefits and services earned through military service and provided by the Department of Veterans Affairs (VA) and other agencies of government; • Providing outreach concerning its program services to the American people generally, and to disabled veterans and their families specifically; • Representing the interests of disabled veterans, their families, their widowed spouses and their orphans before Congress, the White House and the Judicial Branch, as well as state and local government; • Extending DAV’s mission of hope into the communities where these veterans and their families live through a network of state-level Departments and local Chapters; and • Providing a structure through which disabled veterans can express their compassion for their fellow veterans through a variety of volunteer programs.
INSPECTOR GENERAL SEMINAR Fundraising Forget-Me-Not Thrift Store Operations Bar/Lounge Operations Bingo Others – golf tournaments, fishing tournaments, car donation programs, etc.
INSPECTOR GENERAL SEMINAR Forget-Me-Not • Chapters may conduct one annual Forget-Me-Not Drive for a period not to exceed seven days, unless authorized by the Department. • Prior approval from the Department is not required, so long as a promoter is not involved. However, notification of the dates of the event must be provided to the Department. • Departments – A Department may conduct a Forget-Me-Not Drive in areas where there are no local Chapters without prior approval from the National Organization. • ALL FUNDS GENERATED FROM FORGET-ME-NOT DRIVES MUST BE UTILIZED SOLELY FOR THE PURPOSE OF PROVIDING SERVICE TO DISABLED VETERANS, THEIR DEPENDENTS AND SURVIVORS AND NO OTHER PURPOSE.
INSPECTOR GENERAL SEMINAR THRIFT STORE OPERATIONS 1. All new Thrift Store Operations contracts must be entered into by the Department in which the activity is to take place. 2. If a Thrift Store Operation contract between a Chapter and a Management Company existed prior to August 1, 1989, that contract may be renewed so long as it complies with the Bylaws and NEC Regulations. 3. Key items – Contract not to exceed 5 years; Contract must provide for a 180 day written cancellation policy for either party, with or without cause; Shall not contain automatic renewal clause; Must include language which excludes the National Organization from liability; Subordinate entity must receive a minimum of 10% of gross sales before any deductions of any kind; and the NEC must approve all Thrift Store contracts.
INSPECTOR GENERAL SEMINAR BAR/LOUNGE OPERATIONS • May be allowed for the purpose of raising money in order to support service programs for the Chapter or the Department. • NEC Regulation 4 strictly prohibits any bar or lounge operation from operating at a loss. • Currently, there are 53 bar lounge operations and as of this year, 15 are operating at a loss and 17 are just making enough to justify their existence. • The National Organization will be monitoring these programs closely to ensure compliance with NEC Regulation 4. (PLAN OF PROFITABILITY) • Subordinate unit operating the bar/lounge is responsible for regulatory filings.
INSPECTOR GENERAL SEMINAR BINGO OPERATIONS Recently revised NEC Regulation 4 includes Bingo as a program which must not operate at a loss. Currently there are only 76 operations, of which 8 are operating at a loss and 32 are hanging by a thread.
INSPECTOR GENERAL SEMINAR FINANCIAL REPORTS • Accounting year July 1 – June 30. • Due on September 30. • National receives all departments and chapters with gross income (excluding per capita dues) of more than $10 K. • Departments receive all chapters. • Over $300K in income requires a CPA Review.
INSPECTOR GENERAL SEMINAR INTERNAL REVENUE SERVICE • IRS Form 990-N (e-Postcard) under $50K. • IRS Form 990 or 990-EZ over $50K. • Filing deadline November 15, 2009. • Failure to file - Tax exemption revoked after 3 consecutive years. • http://epostcard.form990.org/ • EIN; Legal name and address; Name and address of principal officer.
INSPECTOR GENERAL SEMINAR What will keep us out of trouble? • File C.O.R. timely. • File financial reports timely. • File appropriate IRS Forms. • Safeguard DAV assets and lists. • Receive appropriate approvals for fundraisers. • Integrity – Doing what is right – even when nobody is looking.
