  2. Problem: Travel agents and Travel organizers insolvency Traveller is abroad (language/money) Transport and accomodation firmas deny services because of the TO failing

Abogado Answers: • Directive 90/314/EEC on Package Travel (1992), article 7 • No provisions regarding contracts between TO and transport or accomodation firmas • Financial provisions: the organizer and/or retailer party to the contract shall provide sufficient evidence of security for the refund of money paid over and for repatriation of the consumer in the event of insolvency

Abogado Financial Provisions (OM 1988 and regional provisions) How and how much: a) Bonding (liability, performance, surety, state bond); monies in trust; Quantity: between 60000 – 180000 euros b) Insurance (contractual liability) minimum 450000 euros Which covers: Only money sums declared by final sentences or arbitral awards (the consumer must get through a judicial/arbitral process)

Abogado That means in practical terms: • Travellers may ask for the correct fulfillment of the travel contract to the debtor administrators • In case the transport companies deny the fullfilment f they choose to travel back home, Travellers could be refund by means of bondings or insurance provisions
