Certification • Provides formal recognition of the RAs • Civil Liability • For the purposes of determining liability arising from the dissemination and use of observation data . . . any non-federal asset or regional information coordination entity incorporated into the system . . . shall be considered to be part of NOAA • A requirement of the Act

Guidance Going In • Be realistic • Review all that has been done before • Interagency Ocean Observing Committee (IOOC) is responsible for publishing the criteria • NOAA has a seat equal to other agencies • US IOOS Office membership • Reflect voice of the Regions • Implementable • Meet the requirements for civil liability

Working Groups - Status Data Partners RICE Focusing on governance and management how it relates/supports subsystems Observing DMAC Modeling & Analysis, Training & Education Research & Development • Overall Vision: • Focus on existing protocols • Aligns well with ongoing regional maturity • Related Efforts: • QARTOD* as an existing technical resource pool • DMAC-Steering Team as an effective engagement mechanism • Certification criteria drafted & consultations completed • included NFRA, Weatherflow Inc, NOAA General Counsel, & Jeff DLB • Changes incorporated 2 Groups met at the end of May to reconcile

Public Private Process • Activity: Define processes for making decisions about the roles of the Federal Government, the States, regional information coordination entities, the academic community, and the private sector in providing to end-user communities environmental information, products, technologies, and services related to the System. • ICOOS Act Reference: §12308 • Execution Plan: • Present the IWGOO with a point paper summarizing the outcomes of the Biloxi Town Hall and offer to draft a set of options for the process at the 12/09 meeting. • Research and compile options for presentation to IWGOO at the 02/10 meeting. • Brief IWGOO on options at the February IWGOO meeting. Request comments and feedback from members. • Develop next steps based on IWGOO member comments and suggestions. • Once decision was made, coordinate with IWGOO staff on drafting the policy outlining the process to publish in the Federal Register. • Draft policy was approved by the IOOC and published in the Federal Register for the required 60 day comment period. (completed) • Completion Summary: The final IOOC-approved process was published in the Federal Register on August 11, 2010 with a 60 day comment period beginning on that date. This action completed the requirement as stated in the ICOOS Act.

Industry Instrument/Data Partnership • Weatherflow installed and retains ownership of the weather stations and data • Data will be distributed freely in standard NOAA/NWS formats/frequency, will share data with NOAA/NWS (in accordance with the terms of the NWS/Weatherflow MOA • CaRA has unrestricted distribution of these data, and data products developed by CaRA, for public display. • In place as long as CaRA/IOOS plays O&M
