Privacy Issues • Directive allows all information recovered to be handed over to authorities, instead of specific information necessary to the context of a particular investigation. • Users of new communications (internet, mobile phones, etc.) become worthy of scrutiny for periods of time that States’ legislatures and governments determine on their own.

  3. Legal Issues • Some directive legislation violates the constitution of some EU member nations. • Creation of Comitology procedure for amending the list of retainable information (“for flexibility”) also allows for corruption or unchecked utilization of collected data. • Direct contrast with current legislation regarding data protection practices.

  4. Economic Issues • Bad for nation’s economies – directive does not include any stipulations guaranteeing reimbursement for companies conducting the data retention. • Companies end up spending money retaining data that they do not need for long periods of time • Puts a burden of liability on communications corporations due to increased amounts of unnecessary retention.
