Transportation Conformity Rulemaking • PNR for Transportation Conformity Rule Revisions. • Incorporates SAFETEA-LU Revisions • May 2, 2007: Published in FederalRegister • June 1, 2007: End of comment period • http://www.epa.gov/otaq/stateresources/transconf/conf-regs.htm • Final Rule Imminent. • Primarily incorporating what SAFETEA-LU has already made law. • Streamlining Conformity SIP requirements (more to come in a couple of slides).

Transportation Conformity SIPs • Most states are 3 revisions behind. • Working with states to get updates made & to remove unnecessary SIP triggers (flexibility offered by passage of SAFETEA-LU). • Schedule requested by October 31, 2007. • Alabama only state that has completed SAFETEA-LU compliant SIP for Region 4. • All applicable states indicating that they can provide SIP revision in calendar year 2008.

7. PM2.5 SIPS (mobile component) • Development of motor vehicle emissions budgets more involved than ozone. • EPA Region 4 talking with applicable states to highlight special considerations as SIPs are being developed. • Reminders & helpful hints sent via email on 10/19/2007 to state & locals. • Multi-state nonattainment areas should coordinate for planning assumptions & development of budgets. • EPA guidance released August 2005. • http://www.epa.gov/otaq/stateresources/transconf/policy/420b05008.pdf

Locomotive& Marine Engines Rulemaking Overview • Three-part program to significantly reduce diesel PM. • Program benefits by 2030: • Reduce annual emissions of NOx & PM by 765,000 and 28,000 tons respectively. • Expected to: • Prevent 1,500 premature deaths; • 1,100 hospitalizations; • 170,000 work days lost; and • 1,000,000 minor restricted-activity days • Proposal published on April 3, 2007 • EPA preparing response to comments & final rule • Rule package to OMB by end of November

10. Regional Haze SIPs Chicago in Summer 2000 Clear day: PM2.5 < 5 µg/m3 • Hazy day: PM 2.5 ~ 35 µg/m3

17. EPA Biofuels Strategy • Forming Biofuels Working Group (NOV). R4 POC is Tom Baugh (Energy & Climate Change Coordinator) • Tasks – (1) Develop comprehensive inventory of biofuels activities in Regions; (2) Develop overall EPA biofuels strategy • Science Policy Council will advise WG • EPA on Interagency Biomass R&D Board to develop National Biofuels Action Plan (workshop report/draft May 2007)

EPA Energy Initiative Team • Formed in Sept 07 to support EPA Administrator priority for clean energy and climate change (21 workgroups - HQ/Regions) • 4 Topic areas – Energy Efficiency, Energy Production and Supply, Manufacturing and Industrial Processes, Transportation and Fuels • Alternative Fuels Workgroup Cochair –Scott Davis • Long term task – support the expansion of production and use of alternative fuels consistent with the National Biofuels Action Plan

Fuels Wavier Update • EPA website with Q’s & A’s on process. • Not much new from previous years --- simply compiles information so that it is accessible to the public. • http://www.epa.gov/compliance/resources/faqs/civil/fuelwaiver.html • Regional office can facilitate, so please: • Remember to contact Region 4 in addition to EPA HQ. • Provide updates for Emergency Contacts at your agency if changes from last year. • No waivers needed in 2006 or 2007 hurricane season but several needed in 2004 & 2005 seasons.

23. RVP 8-Hour Ozone Rule • Section 211(h) of Clean Air Act requires low Reid vapor pressure (RVP) fuel in nonattainment areas. • Requirement was previously addressed for 1-hour ozone areas. • EPA currently contemplating rulemaking to address requirement for 8-hour ozone areas.
