  2. When was it created? • The Lacey Act of 1900: -a conservation law introduced by Iowa Rep. John F. Lacey -signed into law by Pres. William McKinley on May 25th, 1900 -amended several times in 1969, 1981, and 1989 -amended again as of May 22nd, 2008 when the Food, Conservation, and Energy Act of 2008 expanded its protection to a broader range of plants and plant products -considered to be international if any plant is in violation of foreign laws that protect plants as well

What is it? -first federal law protecting wildlife -today, the law is primarily used to prevent the importation or spread of potentially dangerous non-native species -expanded to protection of a broader range of plants and plant products too -the law makes it illegal to import, export, transport, sell, receive, acquire, or purchase in interstate or foreign commerce any plant in violation of the laws of the U.S, a State, an Indian tribe, or any foreign law that protects plants -Violation of this federal act can result in civil penalties up to $10,000 per each violation or maximum criminal sanctions of $20,000 in fines and/or up to five years imprisonment.  -All plants or animals taken in violation of the Act are subject to forfeiture as well as all vessels, vehicles, aircraft, and other equipment used to aid in the importing, exporting, transporting, selling, receiving, acquiring, or purchasing of fish or wildlife or plants in a criminal violation of this chapter for which a felony conviction is obtained where the owner should have known of the illegal transgression. -the EPA is responsible for regulation and enforcement
