  1. Data Sharing across Europe A report of the September Association workshop and consideration of the issues

  2. The Event • Requested at the Cyprus conference • 16 Member States in attendance • Included lawyers, technical experts, policy professionals and police representation • Purpose:to map and discuss the issues there are in international data exchange

  3. Tensions • Efficient data exchange vs data owner interest • Data exchange for criminal law purposes vs data exchange for efficient traffic management (including road pricing and parking) • The desire to move forward quickly vs the legality of process and the need for clarity of data definition • Moving ahead in our own field vs moving collaboratively

  4. High level issues to be addressed • Differing interpretation of EU Data Protection law. • Differing states of readiness across MS • Lack of cross border enforcement systems • Differing data definitions hindering IT development • The current readiness of national law. • Differing registration structures and roles • The public sector/private sector divide • Public confidence and political support.

  5. The context • Is there Political will? • Do the Public support the proposed exchange? • Is the Commercial Sector influencing the debate • Through their actions (eg the keeping of customer databases) • Through pressure group activity

  13. So, what next? • Expand our partnerships to include other players in the Field? • Engage with the Commission. • Locate responsibility with a small group under the direction of the Advisory Group? • Further embed and build the analysis of differences, working towards commonality.
