  2. The Law divides blame amongst all offenders: • The Perpetrator – the person who commits the crime. It is possible to be a “co-perpetrator”. (must be present) • Parties to an Offence – people indirectly involved in committing a crime (Mr. Cole gives key to Jake Mang, and then Jake Mang steals gym equipment). • Aiding: helping perpetrator commit a crime • Abetting: encouraging the perpetrator to commit an offence

You should always help a friend…….right????? • Counseling – offering advice, recommending, or persuading another person to commit a crime. • Accessory after the fact – knowingly assist a perpetrator in escaping from the police. • Party to common intention – shared responsibility for any additional offences that are committed during the course of the original crime. (if 6 people hijack a bus and one shoots the driver, all 6 can be charged with murder).

  4. Incomplete Crimes • 1) Attempt – intention to commit a crime even when the crime is not completed (example: discovery of a plot to blow up the school) • 2) Conspiracy – an agreement to carry out an illegal act even if it does not actually occur. (Example: Mallorie and Katherine hire a hitman to kill Mr. Cole.)

  5. Some things to discuss…. • Two friends at school begin playfighting on the playground. When the teacher asks them to stop, the students indicate that their actions are okay because they are just fooling around and they are friends. Two days later one of the students comes to the teacher because “that friend” from the other day gave him a black eye. • Was a crime committed? A rule broken? • What action should be taken against the student? • If you were the teacher, how would you handle the situation?
